SUBJECT CLARIFICATION OF THE NATURE OF ACTIVITY UNDERTAKEN BY ATO REGISTERED COMMON CARRIERS/CHARTER PARTIES

This is to clarify the issue raised by ATO-registered common carriers/charter parties in relation to the implementation of PCSD Admin Order # 05 as amended.

The determination of whether or not a particular carrier is a common carrier or a private carrier within the purview of PCSD Admin Order as amended does not depend on the registration of the air carrier with ATO or any licensing authority but to the nature of the activity that such registered carriers perform in the Province of Palawan. Any common carrier undertaking to carry a special cargo (live fish) or chartered to special person only, becomes a private carrier. As such it is /loT Exempted from the implementation of PCSD AO 00-05,as amended. For strict compliance.
