A RESOLUTION ENJOINING THE PRESIDENTIAL COMMISSION ON ILLEGAL ENTRANTS (PCIE) THROUGH THE PROVINCIAL COMMITTEE TO COORDINATE WITH PCSD IN CASES OF APPREHENSION OF FOREIGN NATIONALS INVOLVED IN ENVIRONMENTAL CRIMES

WHEREAS, pursuant to the policy of the State to protect, develop and conserve its natural resources, Republic Act No, 7611 was enacted on 19 June 1992 adopting a comprehensive framework known as the Strategic Environmental Plan (SEP) for the preservation and enhancement of Palawan environment and at the same time pursue the socio-economic development goals of the country;

WHEREAS, under Section of RA 7611, the Palawan Council for Sustainable Development was created as the administrative machinery for the governance, implementation and policy direction of the SEP, thus it is empowered to call on any department, bureau, office, agency or instrumentality of the government, and on private entities and organization for cooperation and assistance in the performance of its functions;

WHEREAS, in the implementation of SEP and other environmental laws, efforts of the PCSD and the local enforcement agencies are prejudiced in cases where the apprehend violators are foreign nationals who are within the jurisdiction of the PCIE;

WHEREFORE, upon motion of Atty. Grizelda Mayo-Anda, duly seconded by the members present, be it;

RESOLVED, as it is hereby RESOLVED, to enjoin, as it is hereby enjoined, the PCIE to coordinate with PCSD in cases of apprehension of foreign nationals involved in environmental crimes;

RESOLVED FURTHER, that the PCSD and the Provincial Government of Palawan be included in the composition of PCIE;
