PCSD RESOLUTION NO. 98-119A
A RESOLUTION REQUESTING THE DEPARTMENT OF AGRICULTURE TO TURN OVER THE PROVINCIAL AGRICULTURAL CENTER (PAC) TO THE PALAWAN COUNCIL FOR SUSTAINABLE DEVELOPMENT (PCSD)
WHEREAS, in October 1981, the Loan Agreement Nos. 1033/1034 PHI was signed between the Government of the Philippines and the Asian Development Bank for the implementation of the Palawan Integrated Area Development Project (PIADP) as the fifth integrated area development project in the country under the National Council for Integrated Area Development (NACIAD);
WHEREAS, in the same year, the Palawan Integrated Area Development Project Office (PIADPO) was created through Special Order No. 01, series of 1981 as the monitoring and coordination office of the PIADP;
WHEREAS, on the 30th day of March 1982, Porclamation No. 2174 was signed “excluding from the operation of the Executive Order No. 67 dated October 15, 1912 which established the Iwahig Penal Colony situated in the City of Puerto Princesa, Island of Palawan, a portion of the land embraced therein and reserving the same as Provincial Agriculture site for the Palawan Integrated Area Development Project (NACIAD)”, containing an area approximately FIVE MILLION (5,000,000) SQUARE METERS;
WHEREAS, in 1998 upon the recommendation of NEDA, NACIAD was dissolved and Executive Order No. 363 transferred the coordination and monitoring of all IADP’s from the NACIAD to the RDC’s, for Multi-province IADP’s; and by virtue of the aforementioned Executive Order PIADPO continued to function as the monitoring and coordination office of the PIADP under the OPG;
WHEREAS, in June 1992, Republic Act No. 7611, otherwise known as the Strategic Environmental Plan (SEP) for Palawan Act was passed and Section 16 thereof provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD) under the Office of the President;
WHEREAS, Section 20 of the said Act provides that the Palawan Integrated Area Development Project Office, referred to as PIADPO, is converted to the Palawan Council for Sustainable Development Staff which shall serve as the regular professional staff of the Council and shall serve as the machinery to coordinate the policy and functions, implement programs, and organize such services as may be required by the Council in the exercise of its functions. It shall be independent of any other department or agency of the government other than the herein provided Council;
WHEREAS, Section 37 of the Rules and Regulations Implementing Rep. Act No. 7611 provides that “PCSDS shall continue to pursue the coordination, monitoring and evaluation of the Second PIADP, including the implementation of the Project benefit Monitoring and Evaluation System and shall exercise such Appraisal and other relevant project documents;
WHEREAS, Section 20 of R.A. 7611 also provides that all the applicable powers, functions, personnel, complement, staff, appropriations, records, equipment, property, funds and other assets of the PIADPO, as well as, all its obligations and liabilities, are transferred to the Palawan Council for Sustainable Development Staff;
WHEREAS, the foregoing premises necessarily implies that the PAC, previously managed by the DA as the Project Executing Agency of the SPIADP-Agriculture Component shall upon termination of the SPIADP be turned over to the PCSD, the agency that has the jurisdiction over the PAC;
WHEREFORE, upon motion of Cong. Abueg, unanimously seconded by the members present, be it RESOLVED, as it is hereby RESOLVED, that the Department of Agriculture be DIRECTED, as it is hereby DIRECTED, to turn over the Provincial Agricultural Center in Bgy. Irawan, Puerto Princesa City to the PCSD pursuant to Republic Act No. 7611;
RESOLVED FURTHER, that the PCSD Staff be directed, as it is hereby directed to collate all pertinent documents related to the proclamation and other issuance’s in support of PCSD’s claim of the ownership of the PAC;
RESOLVED FURTHERMORE, that the DA be advised, as it is hereby advised, to seek prior clearance from PCSD if the former intends to use the PAC facilities;
RESOLVED FINALLY, that copies of this resolution be furnished the Honorable secretary of the Department of Agriculture for information and guidance.
