RESOLUTION ADOPTING REPUBLIC ACT NO. 8550 OTHERWISE KNOWN AS “THE PHILIPPINE FISHERIES CODE OF 1998”

WHEREAS, R.A. 7611, otherwise known as the Strategic Environmental Plan (SEP) for Palawan, took effect on 19 June 1992 and section 16 of said Act provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD), under the Office of the President;

WHEREAS, Section 7-11 of said act provides for the establishment of an Environmentally Critical Areas Network, the main strategy of SEP which is an graded system of protection and development control over the whole of Palawan, including its tribal lands, forests, mines, agricultural areas, settlement areas, small islands, mangroves, coral reefs seagrass beds and the surrounding sea;

WHEREAS, one of the functions of the PCSD as provided for in Section 19 (8) of R.A. 7611 is to “Adopt, amend and rescind such rules and regulations and impose penalties therefor for the effective implementation of the SEP and the other provisions of this Act”.

NOW THEREFORE, upon motion by Cong. Vicente Sandoval, unanimously seconded by all the members of the present, the Council;

RESOLVED, as it is hereby RESOLVED, to adopt, as it is hereby adopted, the Republic Act No. 8550 otherwise known as the “Philippine Fisheries Code of 1998” to guide the PCSD as well as the LGU’s in the preparation of a uniform policy governing the disposition of marine resources that may be applied by all municipalities in the province of Palawan, in proper coordination with the Provincial Board, the Municipal Councils and City Council of Puerto Princesa City.

RESOLVED FURTHER, that the PCSD Secretariat, the PCSDS, through its District Management Offices (DMO’s) dissemination the said Code to concerned LGU’s.
