A RESOLUTION DIRECTING THE LGUs TO CREATE THE NECESSARY MULTIPARTITE MONITORING TEAMS AND THE EMB, DENR-REGION IV, BUREAU OF MINES OF THE DENR, BFAR-DA, OFFICE OF THE PROVINCIAL GOVERNOR AND OTHER CONCERNED AGENCIES NOT TO ISSUE ANY PERMIT, LICENSE OR ECC WITHOUT PCSD CLEARANCE

WHEREAS, Republic Act 7611 also known as the Strategic Plan for Palawan Act provides that SEP shall guide the local government units of Palawan and the government agencies concerned in the formulation and implementation of plans, programs and projects affecting the province to ensure that the latter’s programs and projects are aligned with the plans, programs and policies of the SEP;

WHEREAS, the issuance of small scale mining and quarrying permits was devolved to the province by vitue of Republic Act 7160 otherwise known as the Local Government Code of 1991; while the issuance of commercial fishing permits and Fishpond Lease Agreements (FLAs), Private Land Timber Permits (PLTPs), Environmental Compliance Certificate (ECCs) and other issuances emanate from DA and DENR, respectively;

WHEREAS, during the 52nd Council meeting held in Coron, Palawan , the Council unanimously agreed to pass a resolution that shall encompass the evaluation and monitoring of the total environmental concerns of Palawan;

WHEREAS, the PCSD under Chapter V, Section 19 of RA 7611 has the authority to call on any department, bureau, office, agency or unstrumentality of the Government, and on private entities and organizations for cooperation and assistance in the performance of its functions;

NOW, THEREFORE, upon unanimous decision of the Council;

RESOLVED FURTHER, that the Council direct the Environmental Management Bureau Regional Executive Director, Bureau of Mines and Geology of the DENR, BFAR-DA, Office of the Provincial Governor and other concerned agenices not to issue any permit, license or ECC without PCSD clearance and to furnish the PCSD every approved permit, license and ECC for purposes of proper monitoring of the multipartite monitoring team that will be created in every city/municipality in Palawan;

RESOLVED FURTHER, that copies of this resolution be furnished to the different LGUs and to the aforementioned agencies for information and appropriate action.
