PCSD RESOLUTION NO. 95-82
RESOLUTION REQUESTING THE DEPARTMENT OF BUDGET AND MANAGEMENT AND THE CIVIL SERVICE COMMISSION TO FORM A JOINT COMMITTEE TO RESOLVE THE ISSUE OF APPOINTMENTS OF PCSDS PERSONNEL PURSUANT TO SECTION 20 OF THE REPUBLIC ACT 7611
WHEREAS, by virtue of Section 16 of Republic Act 7611, the Palawan Council for Sustainable Development (PCSD) was created as the administrative machinery to set policy direction and implement projects. The Council was constituted on 15 August 1992 and the rules and regulations implementing the Act was approved on 4 September 1992.
WHEREAS, pursuant to Section 20 of the same Act, the Palawan Integrated Area Development Project Office was converted into the Palawan Council for Sustainable Development Staff (PCSDS) as the regular professional staff. of the Council. The PIADPO at the time of conversion had 118 permanent positions.
WHEREAS, in accordance with the Councils power to create and approve the organization structure and staffing pattern (Section 19 (7) ) of the PCSDS, the Council, on 4 September 1992, created 27 positions increasing new PCSDS staffing pattern to 145 Positions.
WHEREAS, the Council submitted the new organization structure to the Department of Budget and Management for approval sometime in 1993. The DBM reduced the number of positions to 99 and requested PCSDS to submit a new staffing pattern which the latter submitted on, 24 March .1994. The DBM approved 97 positions as new creation only on 25 November 1994 which was received by the PCSDS on December 1994.
WHEREAS, due to the processing of numerous documents the PCSDS was able to submit the appointments to the Civil Commission on 23 January 1995. Based on the DBM’s letter approving the plantilla, the CSC concluded that the PCSDS is a newly .created office- Hence, the PCSDS was requested to comply with the provisions of RA 7430 (Atrition Law), the CSC MC 38 and 42. The appointments submitted were disapproved based on non-compliance with these later requirements.
WHEREAS, the Council is of the position that the PCSDS is a continuation of the PIADPO and not a newly created government agency, therefore not covered by the CSC rules applicable to newly created agency.
WHEREAS, to classify PCSDS as a newly created agency would result to the following: (i) imposition of additional eligibility requirements upon certain personnel which requirements became effective only in 1 January 1995; (ii) disqualification of eleven incumbent permanent staff occupying key positions in the organization, and (iii) reduction in salary rates of 24 permanent staff in violation of the rules regarding no diminution of salary rates for permanent employees.
WHEREFORE, it is resolved as it is hereby resolved , that the DBM and the CSC be requested to form a committee to resolve the following issues related to the appointment of PCSDS personnel:
1. whether or not PCSDS is a. continuation by virtue of the
conversion, of the PIADPO and not a newly-created agency
2. whether or not PCSDS should be allowed to retroact the
date of appointment of all its personnel. to 1 January
1994.
3. whether or not the additional eligibility requirements
which took effect after the effectivity of RA 7811 should’ be applied to PCSDS personnel.
Resolved further that copy of this resolution be furnished to the Office of the President and the concerned agencies for appropriate action.
