PCSD RESOLUTION NO. 94-57

RESOLUTION REQUESTING THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES TO EXEMPT THE LOCAL GOVERNMENT UNITS OF THE PROVINCE OF PALAWAN FROM SERVICE AND OTHER FEES IN THE ESTABLISHMENT OF COMMUNAL FOREST IN THE PROVINCE.

WHEREAS, R.A 7611, otherwise known as the Strategic Environmental Plan (SEP) for the Palawan, took effect on 19 June 1992 and Section 16 of said Act provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD), under the Office of the President.;

WHEREAS, Section 7-11 of said act provides for the establishment of an Environmentally Critical Areas Network (ECAN), the main strategy of SEP which is a graded system of protection and development control over the whole of Palawan, including its tribal lands, forest, mines, agricultural areas, settlement, areas, small island, mangroves, coral reefs, seagrass, beds, and the surrounding sea;

WHEREAS, the PCSD, in its 23rd Council meeting held on 18 February 1994, adopted the guidelines in implementing the ECAN, prescribing among others, the allowable activities within the identified zones;

WHEREAS, the in its 23rd Council meeting held on 26 November 1993,
adopted the guidelines for the identification and delineation of, ancestral domain and claims in Palawan as part of the SEP’s ECAN;

WHEREAS, one of the functions of the PCSD as provided in section 19(5) of R.A 7511 is to “recommend to the Congress of the Philippines such matters that may require legislation in support of the objectives of the SEP;

WHEREAS, the PCSD recognizes that in implementing the SEP, and the ECAN in particular, one its constraints is the absence of a law that protects the interest of the Indigenous Cultural Communities (ICCs) through the recognition, identification and delineation of their ancestral lands and domain;

NOW THEREFORE, upon motion by Maj. Gen. Carlos F. Tanega, duly seconded by Usec. Ricardo M. Umali, all the members of the Council present;

RESOLVED, as it hereby resolved, that the council express its support to the proposed act on ancestral lands and ancestral domain now pending in congress and request the Honorable Members of Congress to act expeditiously and cause the early passage of the said proposed act;

RESOLVED FINALLY, that the copies of this resolution be sent to the Honorable Members of Congress, local government units and other concerned agencies for their information, consideration and appropriate action;
