PCSD RESOLUTION NO. 94-47

RESOLUTION CONCURRING TO THE PROPOSED TRIPARTITE MEMORANDUM OF AGREEMENT INVOLVING THE CONCESSION AREA OF THE PAGDANAN MULTI-PURPOSE COOPERATIVE INC. UNDER THE COMMUNAL FOREST MANAGEMENT SCHEME, SUBJECT TO THE FINAL RATIFICATION BY THE PALAWAN COUNCIL FOR SUSTAINABLE DEVELOPMENT.

WHEREAS, R.A. 7611, otherwise known as the Strategic environmental Plan (SEP) for Palawan, took effect on June 19, 1992 and section 16 of said Act provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council For Sustainable Development (PCSD), under the Office of the President;

WHEREAS, Section 6 of R.A. 7611 also provides that the SEP shall serve as the framework to guide the government agencies concerned in the formulation of plans, programs and projects affecting the environment and natural resources of Palawan.

WHEREAS, the Department of Environment and Natural Resources (DENR) submitted for concurrence the proposed Tripartite Memorandum of Agreement between and among the DENR, the Pagdanan Timber Products Inc. (PTPI) and the Pagdanan Multi-Purpose Cooperative Inc. (PMPCI), herein attached as Attachment A, involving the concession area of PTPI to be turned-over to the MPMCI under the Communal Forest Management Agreement (CFMA) scheme;

WHEREAS, the Council has already adopted the Guidelines in the implementation of the Environmentally Critical Areas Network;

WHEREAS, the proposed 20,000 hectares CFMA areas specified by the above cited proposed Tripartite Memorandum of Agreement is said to be outside the core zone of the ECAN;

NOW THEREFORE, upon motion by Cong. Alfredo E. Abueg Jr. and Vice-Governor Joel T. Reyes, the members of the Council present;

RESOLVED, as it hereby resolved, that the Council concurs to the proposed Tripartite Memorandum of Agreement between and among the DENR, PTPI and the PMPCI presented before the august body, provided however that upon signing by concerned parties the Memorandum of Agreement shall be subject to the final ratification by the Council;

RESOLVED FINALLY, that a copy of the resolution be furnished to the DENR and other concerned parties for their information and appropriate action.
