RESOLUTION ENJOINING THE PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICE OF PALAWAN TO WITHHOLD THE AMOUNT CORRESPONNDING TO FORTY PERCENT SHARE OF LOCAL GOVERNMENT UNITS FROM THE UTILIZATION AND DEVELOPMENT OF FOREST RESOURCES.

WHEREAS, DENR Memorandum Circular No. 13, series of 1993 and its amendatory Memorandum Circular No.31, series of 1993, provides for the mechanism for effective implementation of Article 390 of the Local Government Code of the Philippines (R.A. 7160) regarding the computation and automatic remittance of the shares of local government units from the utilization and development of forest resources within their area of jurisdiction;

WHEREAS, as provided for in paragraph 3 of Memorandum Circular 31, series of 1993 “xxx the PENRO’s shall handle the computation indicating the corresponding shares of each city, municipality or barangay within his area of jurisdiction and shall consolidate such computed shares to be forwarded to the Finance Management Service, DENR xxx” and paragraph 4 of the same Circular directs the Finance Management Services to “xxx consolidate the computed shares submitted by the PENTO’s and shall forward the same to the Department of Budget and Management for allocation to the Local Government Units (LGUs) concerned per pursuant to Memorandum Circular No.97 dated 01 March 1993 issued;

WHEREAS, it is the Council’s observation that the DBM’s process of releasing the allocated share of the Province from oil revenues takes a considerable time to be affected;

WHEREAS, it is likewise the Council’s belief that if the same process is employed as provided for in the above-cited Memorandum Circular, it is unlikely that the Province’s share from the forest reserves will be released on time;

NOW THEREFORE BE IT RESOLVED, that the Palawan Council For Sustainable Development enjoins the Provincial Environment and Natural Resources Office of Palawan to withhold the amount corresponding to the forty percent share of local government units from the utilization and development of forest resources so as to ensure the immediate release of funds to the concerned LGU’s.

RESOLVE FURTHER, that a copy of this resolution be forwarded to the Department of Environment and Natural Resources for their favorable endorsement tot he oversight Committee on Local Government Code and for the latter to take appropriate remedial measures;
