RESOLUTIONS GRANTING INCENTIVES OR REWARD TO PERSONS INSTRUMENTAL IN THE APPREHENSION OF VIOLATORS OF THE FISHERY AND ENVIRONMENTAL LAWS

WHEREAS, Republic Act No.7611, otherwise known as the Strategic Environmental Plan for Palawan Act had declared that the State, in furtherance of its policy to protect, develop and conserve its natural resources, shall assist and support the implementation of plans, program and projects formulated to preserve and enhance the environment, and at the same time pursue the socio-economic goals of the country;

WHEREAS, , the productive potentials of the vast fishing grounds, other fishery resources and the forests of Palawan upon which a great number of people depend for livelihood and as source of food are greatly being reduced through the employment of illegal fishing, logging and Kaingin, which also __ __ damage and delegation to the natural environment;

WHEREAS, the persons who commit these illegal acts are emboldened by the weak enforcement of fishery and other environmental laws and encouraged by unscrupulous persons who engage in the buying and selling or otherwise disposing for profit fish or other aquatic animals caught or killed through illegal means and logs or other forest products gathered or obtained in violation of environmental laws;

NOW THEREFORE , BE IT RESOLVED as it is hereby resolved that the Palawan Council For Sustainable Development adopt a system that will grant incentives or rewards to persons giving information that will leas to the conviction or otherwise instrumental in the apprehension of persons engaged in illegal fishing, logging or kaingin as defined by existing fishery and environmental laws and/or who buy, posses, deal in sell or otherwise dispose for profit fish or other aquatic animals, logs and other forest products knowing the same to have been illegally taken or gathered in violation of existing fishery and environmental laws,, respectively;

WHERE IT FURTHER RESOLVED that the amount of reward or incentives to be awarded such instruments shall be fifteen percent (15%) of the value of the fish or other aquatic animals, logs or other forest products illegally taken or obtained or one half of the amount of the fine imposed by the court on the offender whichever is higher.
