CSD RESOLUTION NO. 16-559

“DONATING ONE (1) UNIT OF FORFEITED CHAINSAWWITH SERIAL NUMBER 116806781IN FAVOR OF THE EMERGENCY RESPONSE TEAM OFINAGAWAN SUB-PRISON, IWAHIG PRISON AND PENAL FARM, BUREAU OF CORRECTIONSIN ACCORDANCE WITH PCSDADMINISTRATIVE ORDER NO. 7 OR THE REVISED IMPLEMENTING RULES AND REGULATIONS OF THE CHAINSAW ACT OF 2002”

WHEREAS, pursuant to Republic Act 7611, otherwise known as the “Strategic Environmental Plan (SEP) for Palawan Act,” the Palawan Council for Sustainable Development is endowed the duty to promote the development, conservation, management, protection, and utilization of the natural resources of Palawan;

WHEREAS,it is the declared policy of the SEP Law to support and promote the sustainable development goals for the provinces through proper conversation, utilization and development of natural resources to provide optimum yields on a continuing basis. With reference to forest resources, the State shall pursue and implement forest conservation and protection through the imposition of a total commercial logging ban;

WHEREAS,in the Province of Palawan, the power to effectively implement the provisions of Republic Act 9175 of the “Chainsaw Act of 2002” is vested with the Palawan Council

for Sustainable Development which duty includes the obligation to coordinate with the local governments and other concerned agencies to ensure that the latter’s plan, programs and projects are aligned with the plans, programs and policies of the SEP for Palawan Act;

WHEREAS, Section 24 of PCSD Revised Administrative Order No. 07, (AO 07) Series of 2012 or the Revised Implementing Rules and Regulations of the Chainsaw Act of 2002 provides for the Disposition of Forfeited Chainsaw Units which states that chainsaw units which are forfeited under AO 07 in favor of the government may be disposed of through sale and donation in favor of National Government Agencies, Local Government Units and Government Owned and Controlled Corporations;

WHEREAS, the Emergency Response Team of Inagawan Sub-Prison, Iwahig Prison and Penal Farm, Bureau of Corrections, istasked to respond to emergency situations to protect and save life and property, in connection with their mandate of custody and rehabilitation of inmates;

WHEREAS, on September 26, 2016, in a letter-request, the Emergency Response Team ofInagawan Sub-Prison, Iwahig Prison and Penal Farmthrough PGI Reynerio L. Gimpaya, Jr. requested that a chainsaw unit be awarded to the Emergency Response Team to be utilized during calamities;

WHEREAS, in today’s meeting, as a favorable response on the said request,one unit of forfeited chainsaw in the custody of the PCSDS with serial number 116806781shall be donated in favor of the Emergency Response Team of Inagawan Sub-Prison, Iwahig Prison and Penal Farmon the condition that the use of the donated chainsaw shall only be for Disaster Risk Reduction purposes within the vicinity of the Iwahig Prison and Penal Farm;

WHEREFORE, in consideration of the foregoing premises and on motion duly seconded, the Council resolves to authorize PCSD Executive Director Nelson P. Devanadera, as he is hereby AUTHORIZED to execute the corresponding Deed of Donation in favor of theEmergency Response Team of Inagawan Sub-Prison, Iwahig Prison and Penal Farmcovering one (1) unit of forfeitedchainsaw with serial number 116806781;

RESOLVED FINALLY, thatcopies of this resolution be furnished the Emergency Response Team ofInagawan Sub-Prison, Iwahig Prison and Penal Farm and other concerned agenciesfor their information and guidance;
