PCSD RESOLUTION NO. 16-552

“DIRECTING THE ECAN BOARDS TO ACT ON APPLICATIONS FOR THE ISSUANCE OF PCSD PERMITS/CLEARANCES WITHIN 10 DAYS FROM RECEIPT OF THE COMPLETE REQUIRED DOCUMENTS”

WHEREAS, Section 20 of Republic Act No. 7611 or the SEP for Palawan Act provides that the Palawan Council for Sustainable Development Staff(PCSDS) shall serve as the regular professional support staff of the Council and shall provide the machinery to coordinate the policy and functions, implement programs, and organize such services as may be required by the Council; forego

WHEREAS, Section 7 to 11 of the same law provides for the establishment of an Environmentally critical Areas Network (ECAN), the main strategy of the SEP Law, which is a graded system of protection and development control over the whole of Palawan, including itstribal lands, forests, mines, agricultural areas, settlement areas, small islands, mangroves, coral reefs, seagrass beds and the surrounding sea;

WHEREAS, in order to  ensure the implementation  of ECAN at the municipal level, the PCSD issued Administrative Order No. 10, as amended or the Guidelines in the Creation and/or Reconstitution of ECAN Boards in the City/Municipalities of Palawan, Implementing Sections 37-39 of PCSD Resolution No. 05-250, otherwise known as the Revised ECAN Guidelines;

WHEREAS, the ECAN Board under Section 5 (k-vi) of PCSD Administrative Order No. 10 has the power to issue ECAN Board endorsements under other PCSD-implemented laws whenever the PCSD deems the same necessary prior to issuance of the corresponding permits as may hereinafter be provided in the implementing rules and procedures of RA 9147, RA 9175, RA 9072 and other similar laws;

WHEREAS, Section 8 of Republic Act No. 9485 or the “Anti-Red Tape Act of 2007” provides for the Accessing Frontline Services, to wit:

xxx The following shall be adopted by all government offices and agencies:

(a) Acceptance of Applications and Request – (1) All officers or employees shall accept written applications, requests, and/or documents being submitted by clients of the office or agencies.

(2) The responsible officer or employee shall acknowledge receipt of such application and/or request by writing or printing clearly thereon his/her name, the unit where he/she is connected with, and the time and date of receipt.

(3) The receiving officer or employee shall perform a preliminary assessment of the request so as to promote a more expeditious action on requests.

(b) Action of Offices – (1) All applications and/or requests submitted shall be acted upon by the assigned officer or employee during the period stated in the Citizen’s Charter which shall not be longer than five working days in the case of simple transactions and ten (10) working days in the case of complex transactions from the date the request or application was received. xxx

WHEREAS, in order to facilitate PCSD’simmediate action on applications for permits and clearances; a ten (10) day period is given to the ECAN Boards within which to convene and issue the corresponding ECAN Board action; provided that, the ECAN Board’s failure to act within the said period shall constitute as waiver of its authority to act on the application;

WHEREFORE, in consideration of the foregoing premises and on motion duly seconded, the Council resolves as it is hereby resolved DIRECTING, the ECAN Boards to act on applications for issuance of PCSD permits/clearances within ten (10) days from receipts of the complete required documents;

RESOLVED FURTHER, that the ECAN Boards failure to act within the 10-day period shall be deemed waiver of its authority to act on the application;

RESOLVED FINALLY, that copies of this resolution be furnished the ECAN Boards,other concerned agencies and LGU’s for their information and guidance;
