PCSD RESOLUTION NO. 16-543

DONATING ONE (1) UNIT OF CONFISCATED CHAINSAW UNDER THE CUSTODY OF PCSD IN FAVOR OF THE LOCAL GOVERNMENT OF BROOKE’S POINT”

 

WHEREAS, pursuant to Republic Act 7611, otherwise known as the “Strategic Environmental Plan (SEP) for Palawan Act,” the Palawan Council for Sustainable Development is endowed the duty to promote the development, conservation, management, protection, and utilization of the natural resources of Palawan;

 

WHEREAS, it is the declared policy of the SEP Law to support and promote the sustainable development goals for the provinces through proper conversation, utilization, and development of natural resources to provide optimum yields on a continuing basis. With reference to forest resources, the State shall pursue and implement forest conservation and protection through the imposition of a total commercial logging ban;

 

WHEREAS,in the Province of Palawan, the power to effectively implement the provisions of Republic Act 9175 of the “Chainsaw Act of 2002” is vested with the Palawan Council for Sustainable Development which duty includes the obligation to coordinate with the local governments and other concerned agencies to ensure that the latter’s plan, programs, and projects are aligned with the plans, programs and policies of the SEP for Palawan Act;

 

WHEREAS, Section 24 of PCSD Revised Administrative Order No. 07, Series of 2012 or the Revised Implementing Rules and Regulations of the Chainsaw Act of 2002 provides for the disposition of forfeited chainsaw units which states that chainsaw units which are forfeited under AO 07 in favor of the government may be disposed of through sale and donation in favor of national government agencies, local government units and government-owned and controlled corporations;

 

WHEREAS, the Municipal Government of Brooke’s Point through the MENRO is charged with the management, conservation, preservation and protection of the environment and natural resources of the Municipality and is thus obligated to carry out the policies and regulations pertaining to environmental protection;

 

WHEREAS, in a correspondence written by Remie L. Mostiero, MPA, Administrative Assistant II, MAssO/MENRO – Designate to the Palawan Council for Sustainable Development dated June 11, 2015, the former requested that a unit of chainsaw be donated to the local government of Brooke’s Point for the effective implementation of policies and regulations pertaining to environmental protection;

 

WHEREAS, the local government of Brooke’s Point use chainsaw unit/s in the performance of official functionis an eligible donee of a chainsaw unit as expressly provided for under Section 8.1 (b) of PCSD Administrative Order No. 07, series of 2012;

 

WHEREAS, in the meeting of the PCSD Legal and Inter-governmental Committee, the LGU’s request was formally recommended to be the donee of one (1) unit of confiscated chainsaw in the custody of PCSD with chasis no. 911097917601to be used by the latter in disaster related activities;

 

WHEREAS,that the purpose of donating the forfeited chainsaw by the PCSD in favor of the Local Government of Brooke’s Point is to aid the latter in effectively implementing their Disaster Risk and Management Plan and at the same time, will ensure that confiscated chainsaw under the custody of the PCSD shall remain serviceable and functional for legal and public purpose;

 

WHEREFORE, in consideration of the foregoing premises and on motion duly seconded, the Council resolves to authorize PCSD Executive Director Nelson P. Devanadera, as he is hereby AUTHORIZED to execute the corresponding Deed of Donation in favor of theLocal Government of Brooke’s Point covering one (1) unit of confiscated chainsaw with chasis no. 911097917601;

 

RESOLVED FINALLY, that copies of this resolution be furnished the Local Government of Brooke’s Point,MENRO of Brooke’s Point, and other concerned agenciesfor their information and guidance;

 

ADOPTED AND APPROVED this 31st day of March 2016 at Governor’s Conference Room, Second Floor, Capitol Complex Building, Puerto Princesa City.
