PCSD RESOLUTION NO. 15-535

“AMENDING SECTION 16 OF PCSD ADMINISTRATIVE ORDER NO. 6, SERIES OF 2014, ALLOWING THE DENR TO PROCESS APPLICATIONS FOR FOREST LAND USE AGREEMENTS (FLAg) FOR VARIOUS PURPOSES, INCLUDING TOURISM PURSPOSE (FLAgT) PRIOR TO THE ISSUANCE OF SEP CLEARANCE”

 

 

WHEREAS, Republic Act No. 7611 took effect on 19 June 1992 providing for the Strategic Environmental Plan (SEP) for Palawan as the framework that should guide the government agencies concerned in the formulation of plans, programs and projects affecting the environment and natural resources of Palawan;

 

WHEREAS, Section 16 of the same law provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD);

 

 

 

            WHEREAS, Section 19, paragraph 8 empowers the Council to “adopt, amend and rescind such rules and regulations and impose penalties for the effective implementation of the SEP;

WHEREAS, to ensure the attainment of SEP’s goals and objectives, the PCSD promulgated in 2000 the Guidelines in the Implementation of SEP Clearance System, amended thrice – in 2002,  2008 and 2014 – otherwise known as the PCSD Administrative Order No. 6, series of 2014;

 

WHEREAS, Section 16 of the said Administrative Order reiterates the previous provisions stating that the DENR shall not issue an ECC, CNC, license, permit and similar instruments without the SEP Clearance issued by the PCSD in accordance with the Memorandum of Agreement between the DENR and the PCSD executed on December 29, 1994;

 

WHEREAS, the Council observed the increasing number of applications for SEP Clearance for Forest Land Use Agreements (FLAg) for various purposes, including tourism purpose (FLAgT) in the province of Palawan;

 

WHEREAS, the continuous increase in the number of FLAg for various purposes may pose adverse impacts to Palawan’s environment and natural resources;

 

WHEREAS, in order to ensure that the land subject of the applications cannot be titled to private persons and to define the entitlements and limitations of the grantees under the said Agreements, all applications shall be evaluated first by the DENR as an exemption to the existing procedures in the PCSD;

 

WHREFORE, in consideration of the forgoing premises, and upon motion duly seconded, be it resolved as it is hereby RESOLVED amending Section 16 of PCSD Administrative Order No. 6, series of 2014, allowing the DENR to process applications for Forest Land Use Agreements (FLAg) for various purposes, including tourism purpose (FLAgT) prior to the issuance of SEP clearance.

 

RESOLVED FINALLY, that a copy of this resolution be furnished the project applicants and the DENR for their information and guidance.
