A RESOLUTION DEPUTIZING TEN (10) APPLICANTS AS WILDLIFE ENFORCEMENT OFFICERS FOR THE PROVINCE OF PALAWAN PURSUANT TO PCSD RESOLUTION NO. 06-313A IN RELATION TO SECTION 30 OF RA 9147 OR THE WILDLIFE RESOURCES CONSERVATION AND PROTECTION ACT AND ITS IMPLEMENTING RULES AND REGULATIONS
WHEREAS, on 30 July 2001 Republic Act 9147 was approved into law and known as the Wildlife Resources Conservation and Protection Act;
WHEREAS, Section 4 of RA. 9147 provides that in the Province of Palawan, jurisdiction as to the implementation of the law is vested with the Palawan Council for Sustainable Development pursuant to R.A. No. 7611.
WHEREAS, Section 30 of the same Act requires the implementing agencies to deputize Wildlife Enforcement Officers (WEOs) that shall have the full authority to seize illegally traded wildlife and to arrest violators of the Act, subject to the existing laws, rules and regulations on arrest and detention;
WHEREAS, in relation to the aforementioned Section 30, an implementing rules and regulations was jointly issued by the DENR, DA and PCSD, Rule 30.1 of which provides that the Council or its authorized representative shall deputize Wildlife Enforcement Officers from non-government organizations, citizens groups, community organization and other volunteers who have undergone the necessary training for this purpose;
WHEREAS, in compliance with Rule 30.5 of the above-mentioned implementing rules and regulations requiring the Council to prescribe the requirements and procedures for the deputation of WEOs in the province of Palawan, the Council passed PCSD Resolution No. 06-313A, entitled “A Resolution Approving the Guidelines Prescribing the Requirements and Procedures for the Deputation and Designation of Wildlife Enforcement Officers (WEOs) Pursuant to Republic Act 9147, Otherwise Known as the Wildlife Resources Conservation and Protection Act and its Joint Implementing Rules and Regulations”;
WHEREAS, pursuant the above-mentioned Council resolution, on July 1, 2008, the PCSDS conducted WEO Training in the Municipality of El Nido, Palawan, wherein ten (10) participants satisfactorily passed the examinations and complied with the documentary requirements for their deputation;
WHEREAS, considering the policy of the State to conserve and protect the country’s wildlife resources and their habitats for sustainability, the Council recognizes the potential of the 10 participants who passed the trainings;
WHEREFORE, for and in consideration of the foregoing premises and on motion duly seconded, be it RESOLVED as it is hereby RESOLVED to deputize the ten (10) applicants, namely: Robert L. Jaboli, Annan P. Aniban, Raffy G. Cabate, Rene Jay M. Dela Calzada, Jacques G. Arzaga, Raymond B. Osorio, Bienvenido S. Veguilla, Jr., Richard T. Moralde, Rey A. Reyes and Jojit V. Apayan, as they are hereby deputized as Wildlife Enforcement Officers for the Province of Palawan pursuant to PCSD Resolution No. 06-313A in relation to Section 30 of RA 9147 or the Wildlife Resources Conservation and Protection Act and its Implementing Rules and Regulations.
RESOLVED FINALLY, that copies of this Resolution be sent to Hon. Leonora D. Corral, El Nido Municipal Mayor, the Secretary of the Sangguniang Bayan of El Nido and the Chief of Police of the Municipal Police Station of El Nido, Palawan for their information, consideration and appropriate action.
