PCSD RESOLUTION NO. 08-365
A RESOLUTION SUSPENDING THE REGISTRATION OF CHAINSAW UNITS ISSUED FOR REASONS OF PERSONAL USE AND THOSE WITH OCCASIONAL HIRING AND/OR FOR BUSINESS PURPOSE(S) AND REQUIRING THE RESPECTIVE REGISTERED OWNERS TO FILE A NEW APPLICATION STATING THEREIN THEIR QUALIFICATION AS PROVIDED FOR BY THE CHAINSAW ACT
WHEREAS, Republic Act 7611 or the Strategic Environmental Plan (SEP) for Palawan, provides for the comprehensive framework for the sustainable development of Palawan compatible with enhancing the natural resources and endangered environment of the province and created the Palawan Council for Sustainable Development (PCSD) as the administrative machinery for its implementation, governance and policy direction;
WHEREAS, Paragraph 8, Section 19 of the SEP Act provides that the Council has the power to adopt, amend and rescind rules and regulations and impose penalties therefor for the effective implementation of the SEP and the other provisions of the SEP Act;
WHEREAS, paragraph two (2), Section 9 of Republic Act No. 9175, otherwise known as the “Chainsaw Act of 2002”, provides, that “In the Province of Palawan, the provisions of this Act shall be implemented by the Palawan Council for Sustainable Development pursuant to Republic Act No. 7611 or the Strategic Environmental Plan (SEP) for Palawan”.
WHEREAS, on September 12, 2003, the Council on a Special Council Meeting passed PCSD Resolution No. 03-215, approving the Implementing Rules and Regulations of the Chainsaw Act, which became the basis of PCSD Administrative Order No. 07, series of 2003, regulating the purchase, ownership, possession, sale, transfer, importation and/or use of chainsaw in the province;
WHEREAS, pursuant to the aforementioned Administrative Order, there were chainsaw units that were registered for personal use but with an additional purpose for occasional hiring and/or for business purposes, which were not among those provided for by law;
WHEREAS, to effectively achieve the intent of the framers of the law and therefore pursue forest protection program declared under Republic Act 9175, the subject Administrative Order was amended on 17 November 2006, through PCSD Resolution No. 06-313 or “A Resolution amending PCSD Administrative Order No. 07, series of 2003, otherwise known the Implementing Rules and Regulations of the Chainsaw Act of 2002 for the Province of Palawan”. Such amendment was in harmony with the spirit and the intent of the framers of the law, hence, the provision of PCSD Administrative Order No. 07, Series of 2003, which provides for the hiring of chainsaw unit was removed;
WHEREAS, in view of the numerous applications for the purchase as well as registration of new units there is a need to extensively evaluate the qualifications of persons who are applying for registration or purchase of chainsaw, including the re-evaluation of registered owners whose purpose is for personal use and those with occasional hiring and/or for business purpose(s);
NOW THEREFORE, upon unanimous decision, the Council resolves as it is hereby RESOLVED, to SUSPEND as it is hereby SUSPENDED the registration of chainsaw units for personal use and those with occasional hiring and/or business purpose(s) and to require the respective registered owners to file a new application stating therein their qualification as provided for by the Chainsaw Act.
RESOLVED FURTHER, that the concerned chainsaw owners be notified accordingly and the District Management Offices (DMO) of the PCSDS be directed as it is hereby directed to evaluate the applications.
RESOLVED FINALLY, that the concerned DMO shall, after evaluation or re-evaluation of the applications, render a report to the Council for information and appropriate action.
