A RESOLUTION CREATING THE WILDLIFE SUB-COMMITTEE OF THE ENVIRONMENT AND NATURAL RESOURCES COMMITTEE OF THE PCSD

WHEREAS, on July 30, 2001 Republic Act 9147, otherwise known as the “Wildlife Resources Conservation and Protection Act” was approved to carry out the national policy of conserving the country’s wildlife resources and their habitat for sustainability;

WHEREAS, based on Section 4 of the aforementioned Act, the Department of Environment and Natural Resources (DENR) and Department of Agriculture (DA) are the two government agencies mandated in its nationwide implementation while in the province of Palawan, the jurisdiction was conferred to the Palawan Council for Sustainable Development (PCSD) pursuant to Republic Act No. 7611;

WHEREAS, Section 6 of the same Act states that all activities shall be authorized upon proper evaluation of best available information or scientific data showing that the activity is, or for a purpose, not detrimental to the survival of the species or subspecies involved and/or their habitat;

WHEREAS, in relation to the aforementioned Sections 4 and 6, the implementing rules and regulations of RA 9147 were jointly issued by the DENR, DA and PCSD;

WHEREAS, under Rule 6.1 of the Joint Implementing Rules and Regulations of this Act, a National Wildlife Management Committee (NWMC) shall be created separately by the DENR, DA and PCSD to provide technical and scientific advice to the DA and DENR Secretaries and the Council in the implementation of the Wildlife Resources Conservation and Protection Act;

WHEREAS, in 2006, there were consultations initiated by the PCSD Staff which were participated in by representatives from agencies concerned including the academe, scientific individuals and entities regarding the creation of a Wildlife Management Committee for Palawan pursuant to the Wildlife Act;

WHEREAS, a draft operational guidelines of the said wildlife committee was presented and was subsequently approved during the 15 May 2008 regular meeting of the Environment and Natural Resources Committee of the PCSD (ENR-PCSD);

WHEREAS, it was resolved during the aforecited meeting that the proposed Wildlife Management Committee shall be created as a sub-committee of the ENR Committee of the PCSD;

WHEREAS, the created Wildlife Sub-committee of the ENRC-PCSD could also serve as the Wildlife Committee required to be created under Rule 26.1 of the Joint DENR-DA-PCSD Administrative Order No. 1;

WHEREFORE, for and in consideration of the foregoing premises and on motion duly seconded, the Council RESOLVED, as it is hereby RESOLVED to create a Wildlife Sub-committee under the Environment and Natural Resources Committee of the PCSD;

RESOLVED FINALLY, that copies of this resolution be furnished the PAWB-DENR, DA, LGUs and other concerned agencies for their information and guidance.
