PCSD RESOLUTION NO. 99-141

A RESOLUTION DIRECTING ALL CITY / MUNICIPAL MAYORS TO REQUIRE ALL PEARL FARM OPERATORS TO SECURE CLEARANCE FROM THE PCSD PRIOR TO THE ISSUANCE OF LEASE AGREEMENTS AND PERMITS TO OPERATE

WHEREAS, Republic Act 7611 also known as the Strategic Plan for Palawan Act provides that SEP shall guide the local government units of Palawan and the government agencies concerned in the formulation and implementation of plans, programs and projects affecting the province to ensure that the latter’s plans, programs and projects are aligned with the plans, programs and policies of the SEP;

WHEREAS, Section 19 (3) empowers the PCSD to “call on any department, bureau, office, agency or instrumentality of the Government, and on private entities and organizations for cooperation and assistance in the performance of its functions”;

WHEREAS, power to issue permits for pearl farming pertains to the city/municipal mayors pursuant to the Local Government Code of 1991 or R.A. 7160 and Section 52 of the New Fisheries Code or R.A. 8550;

WHEREAS, Atty. Grizelda Mayo-Anda reported the complaints of fisherfolks in Taytay and Coron-Busuanga area regarding the very limiting and restrictive impositions made by pearl farm operators to the extent that small fisherfolks can no longer have free ingress and egress in pearl farm areas;

WHEREAS, in order to effectively carry out the proper monitoring of pearl farms operators on the provisions of the issued permits, licenses and environmental compliance certificates, pearl farm operators must be required to secure clearance from the PCSD prior to the issuance by the LGU’s of permit to operate or the lease agreement;

WHEREFORE, upon the motion of Vice Chairman Vicente Sandoval, unanimously seconded, by the members present, be it:

RESOLVED, as it is hereby RESOLVED, to direct all city/municipal mayors, as they are hereby DIRECTED, to require all pearl farm operators to secure clearance from the PCSD prior to the issuance of lease agreements and permits to operate.

RESOLVED FURTHER, that all pearl farm operators are henceforth required to apply for the issuance of authorization from the PCSD.

RESOLVED FINALLY, that copies of this resolution be furnish to the LGU’s, pearl farm operators and other concerned agencies for information and appropriate action.
