PCSD RESOLUTION NO. 04-233
A RESOLUTION ALLOWING ALMACIGA TAPPING BY INDIGENOUS PEOPLES (IPs) IN THE CORE ZONE IN AREAS CLASSIFIED BY THE PALAWAN COUNCIL FOR SUSTAINABLE DEVELOPMENT (PCSD) AS TRIBAL ANCESTRAL LANDS PURSUANT TO SECTION 11 OF REPUBLIC ACT NO. 7611, OTHERWISE KNOWN AS THE STRATEGIC ENVIRONMENTAL PLAN (SEP) FOR PALAWAN ACT.
WHEREAS, it has been the policy of the state to recognize and promote all the rights of Indigenous Cultural Communities/Indigenous Peoples (ICC/Ps) within the framework of the constitution as enumerated in section 2 of Republic Act. No. 8371 (An act to recognize, protect and promote the rights of indigenous cultural communities/indigenous peoples, establishing implementing mechanism, appropriating funds therefor, and for other purposes).
WHEREAS, Section 9 of the SEP law requires the core zone to be fully and strictly protected and maintained free of human destructions. Such core zone include “… natural forests and areas above 1000 meters elevation.” among others, which are the usual habitat of almaciga trees;
WHEREAS, Section 11 of the SEP law provides for the zonation of tribal ancestral lands that requires ‘La special kind of zonation to fulfill the material and cultural needs of the tribes using consultative processes and cultural mapping of the ancestral lands”;
WHEREAS, the PCSD, as the administrative machinery created for the governance, policy direction and implementation of Republic Act. No 7611. is mandated to establish and declare zones under the Environmentally Critical Areas Network (ECAN), as the main strategy of the SEP;
WHEREAS, Section 11 further provides that tribal ancestral lands, which are traditionally occupied by IP’s shall be treated in the same graded system of control and prohibition as in the other components of ECAN, except for strong emphasis in cultural considerations; this means that the core zone of tribal ancestral lands shall likewise be protected, free of human disruption, except that the IP’s could be allowed to gather minor forest products, like almaciga resin, so as not to deprive them of their basic source of livelihood;
WHEREAS, the above exemption is consistent with the existing policy of the PCSD as provided for under PCSD Resolution No. 94-63, granting preferential rights to indigenous peoples to tap or gather minor forest products, particularly almaciga resin;
WHEREAS, IP’s traditional knowledge in tapping almaciga has been proven to be sustainable;
WHEREAS, such preferential treatment accorded to the IP’s is in accordance with the declared policy of the SEP to promote and encourage the involvement of all sectors ofsociety and maximize people participation, including tribal groups, in natural resource management. conservation and protection;
WHEREAS, upon the motion of Usec. Renato De Rueda duly seconded by Mr. Angel Antic, be it resolved, as it is hereby resolved, to allow almaciga tapping by indigenous people’s in the core zone in areas classified by the PCSD as Tribal Ancestral Lands under Section 11 of Republic Act No. 7611;
RESOLVED FURTHER, that concessions to such almaciga areas in the tribal ancestral lands be granted to the indigenous peoples in the province of Palawan;
RESOLVED FINALLY, that the PCSD Staff take immediate action to fast track the delineation of the tribal ancestral lands pursuant to Section 11 of Republic Act No. 7611.
