PCSD RESOLUTION NO. 03-223
A RESOLUTION REVOKING THE SEP CLEARANCE ISSUED TO SAN MIGUEL PEBBLE GATHERERS MULTI-PURPOSE COOPERATIVE TO GATHER PEBBLE ALONG THE SHORELINE OF SAN MIGUEL, LINAPACAN FOR BEING CONTRARY TO EXISTING PCSD POLICY.
WHEREAS, the Palawan Council for Sustainable Development in several occasions has adopted the Republic Act No. 8550 otherwise known as “The Philippine Fisheries Code of 1998” and has become the basis for adopting the policy prohibiting pebble gathering along beaches and shorelines;
WHEREAS, the PCSD through Resolution No. 03-208 delegated to the Executive Director the authority to approve applications for SEP Clearance of “projects located in Environmentally Critical Areas and environment enhancement projects, research projects that does not require bioprospecting and similar undertakings that are to be carried out to generate data and information, and other projects identified by the PCSD”, subject to review and approval by the Council;
WHEREAS, the Executive Director issued SEP clearance on October 8, 2003 to San Miguel Pebble Gatherers Multi-Purpose Cooperative to gather pebbles along the shoreline of San Miguel, Linapacan, Palawan;
WHEREAS, the Executive Director submitted to the Council the above-mentioned issuance of SEP Clearance for review and concurrence in accordance with the established procedures;
WHEREAS, after thorough deliberation the council found the above issuance to be contrary to existing PCSD policy prohibiting pebble gathering along beaches and shorelines;
WHEREFORE, on motion duly seconded, be it resolved, as it is hereby resolved, to revoke, as it is hereby revoked, the SEP clearance issued to San Miguel Pebble Gatherers Multi-Purpose Cooperative to gather pebbles along the shoreline of San Miguel, Linapacan, Palawan for being contrary to existing PCSD policy.
RESOLVE FINALLY, that the concerned proponent and agencies be furnished copy of this resolution for their information and guidance.
