PCSD RESOLUTION NO. 03-213

RESOLUTION ENDORSING FAVORABLY THE PROPOSED AMENDMENT OF PRESIDENTIAL PROCLAMATION NO. 275 AS REQUESTED BY THE AFFECTED STAKEHOLDERS AND THE LOCAL GOVERNMENT UNIT (LGU) OF NARRA, PALAWAN THRU MAYOR LUCENA DIAZ DEMAALA

WHEREAS. R.A. 7611, otherwise known as the Strategic Environmental Plan (SEP) for Palawan, which took effect on 19 June 1992 provides that the SEP shall serve as the framework to guide the government agencies concerned in the formulation of plans, programs and projects affecting the environment and natural resources of Palawan;

WHEREAS, Section 7 of R.A. 7611 provides that the SEP shall establish a graded system of protection and development control over the whole of Palawan, including its tribal lands, forests, mines, agricultural areas, settlement areas, small islands, mangroves, coral reefs, seagrass beds and the surrounding sea known as the Environmentally Critical Areas Network (ECAN);

WHEREAS, on June 20,1988, President Corazon C. Aquino signed Proclamation No. 275 which reserved certain portions of the land of the public domain as Municipal High School site containing an area of 80,330 square meters under Lot-724-A, Csd-4A-002102-D and National Government Center Site containing an area of 2,492,955 square meters under 742-B, Csd-4A-002102-D, both of which formed part of what used to be known as the “Hacienda de Panacan”.

WHEREAS, the issuance of Proclamation No. 275 enhanced the propriety rights of the Municipal Government of Narra, Palawan over Lot 742-B, Csd-4A-002102-D;

WHEREAS, the affected stakeholders and the Local Government Unit (LGU) of Narra, Palawan through Mayor Lucena Diaz Dimaala, requested the Palawan Council for Sustainable Development (PCSD) for a favorable endorsement of the proposed amendment of Presidential Proclamation No. 275;

WHEREAS, the proposed amendment aims to exclude certain portions from the National Government Center Site and declare the same open for disposition for Government Center Site and Socialized Housing site;

WHEREAS, the proposed lots allocation for the socialized housing site are; Antipuluan barangay site, Panacan Barangay Site, Farmers residential area, Government employee site, cemetery site, Landless, Muslim village and cemetery site, Urban poor and Institutional and structural facilities;

WHEREAS, the aforementioned areas fall under the multiple-use zone of the revised EC AN map of the municipality of Narra where the proposed project may be allowed;

WHEREAS, based on the review of the submitted documents and on-site evaluation conducted by the PCSD Staff, it is recommended that the PCSD issues a favorable endorsement subject to the compliance on terms and conditions posted by the technical Staff of the PCSDS as well as the members of the PCSD;

WHEREAS, the PCSD Staff recommended for the creation thru an Executive Order a Local Inter-Agency Committee (LIAC) to prepare among others necessary documents implementing rules and regulations for the detailed implementation of socialized housing program;

WHEREAS, the composition of the above cited Local Inter-Agency Committee will be jointly identified by the Local Government Unit and Hon. Abraham B. Mitra, Representative for the 2nd District of Palawan;

WHEREAS, the said Local Inter-Agency Committee would ensure that the Municipality of Narra will apply for SEP Clearance/ECC in compliance with PCSD Administrative Order No. 6 and PD No. 1586 (Philippine Environmental Impact Assessment (EIS) System) before undertaking any activities in the area;

NOW THEREFORE, upon motion by Atty. Joselito C. Alisuag, duly seconded by Exec. Dir. Winston G. Arzaga and all the members of the Council present;

RESOLVED, as it is hereby resolved, that the Council endorses favorably the proposed amendment of Presidential Proclamation No. 275 as requested by the affected stakeholders and the Local Government Unit (LGU) of Narra, Palawan thru Mayor Lucena Diaz Demaala;

APPROVED AND ADOPTED this 1st day of September 2003, in the Municipal Hall, Municipality of Busuanga, Palawan.
