PCSD RESOLUTION NO. 01-176
RESOLUTION ACCEPTING THE FRANCHISE TO CONSTRUCT, INSTALL, ESTABLISH, OPERATE AND MAINTAIN RADIO AND/OR TELEVISION BROADCASTING STATION IN THE PROVINCE OF PALAWAN GRANTED UNDER REPUBLIC ACT NO. 8993.
WHEREAS, the Strategic Environmental Plan (SEP) for Palawan, adopted under Republic Act No. 7611, provides for the comprehensive framework for the sustainable development of Palawan compatible with enhancing the natural resources and endangered environment of the province and created the Palawan Council for Sustainable Development (PCSD) as the administrative machinery for its implementation, governance and policy-direction;
WHEREAS, Section 20 of RA No. 7611 tasked the PCSD Staff to serve as the PCSD’s regular professional staff that shall provide the machinery to coordinate the policy and functions, implement programs, and organize such services as may be required by the Council in the exercise of its functions;
WHEREAS, the Palawan Tropical Forestry Protection Programme (PTFPP) was established as PCSD’s special project, with financial assistance from the European Union, for the purpose of assisting in the preservation of Palawan forests through an area-based project emphasizing a community-based sustainable development strategy within the framework of the SEP the National Integrated Protected Area System (NIPAS) under RA 7586;
WHEREAS, as mandated by the Financing Memorandum between the European Union and the Government of the Philippines, the PTFPP shall establish three (3) new community radio stations in Palawan and in pursuance thereof a Memorandum of Agreement between PTFPP and Tambuli, a cooperative project of UNESCO, DANIDA and the Government of the Philippines, was signed to assist the PTFPP in the establishment and operations of the community radio station for the purpose of increasing environmental awareness of the people and the community at large;
WHEREAS, in the PTFPP’s baseline research for the community-based radio station, the communities have manifested keen interest in the radio station project and expressed willingness to offer unified efforts for the project’s operation;
WHEREAS, in 1998, the PCSD through its Chairman, Hon. Alfredo E. Abueg, Jr., filed House Bill No. 5143 with the House of Representatives and brought to the Senate as Senate Bill No. 5805, requesting for a franchise to construct, install, establish, operate and maintain radio and/or television broadcasting station in the province of Palawan, which was finally signed by the President on January 5, 2001 as Republic Act No. 8993;
WHEREAS, Section 7 of Republic Act No. 8993 requires that acceptance of this franchise shall be given in writing sixty (60) days from the effectivity of this Act and that non-acceptance shall render the franchise void;
WHEREFORE, on motion duly seconded, the Council RESOLVES, as it is hereby RESOLVED, to ACCEPT, as it is hereby ACCEPTED, the franchise to construct, install, establish, operate and maintain radio and /or television broadcasting station in the Province of Palawan granted under Republic Act No. 8993.
RESOLVED FINALLY, that the Congress of the Philippines be furnished with copy of this resolution of acceptance for their information.
