PCSD RESOLUTION NO. 00-170
RESOLUTION CREATING THE JOINT PCSD-DENR COORDINATING COMMITTEE
WHEREAS, on 29 December 1994, the PCSD and the DENR entered into an agreement known as the “Mother MOA” harmonize the complementary roles and functions of both agencies in the protection, conservation, utilization, development and management of natural resources and environment of Palawan;
WHEREAS, the need to harmonize the two agency’s mandate was born out of the enactment in June 19, 1992 of Republic Act No. 7611, otherwise known as the Strategic Environmental Plan (SEP) for Palawan Act, which created the Palawan Council for Sustainable Development as the administrative machinery for the governance, implementation and policy direction of the SEP;
WHEREAS, Section 4 of Republic Act No. 7611 provides for the SEP as the framework to guide government agencies concerned in the formulation and implementation of plans, programs and projects affecting the environment and natural resources of Palawan and requires that local governments in Palawan and the concerned national and regional government agencies operating in the province shall coordinate and align their plans program, projects and policies of the SEP, as formulated, administered and implemented by the PCSD;
WHEREAS, under Section 2, Chapter 1, Title XIV of Executive Order 292, the DENR is tasked with the primary responsibility of carrying out the States’s constitutional mandate to control and supervise the exploration, development, utilization, and conservation of the country’s natural resources, while the PCSD under Republic Act No. 7611 is tasked with the same responsibility with respect to Palawan;
WHEREAS, the DENR issues licenses and permits and enter into agreements for the utilization and development of forest and mineral resources in the country, while the PCSD endorses projects or undertaking pertaining thereto in Palawan as prerequisites to such issuance by the DENR;
WHEREAS, the DENR acknowledges the mandate of PCSD to provide policy direction, exercise the governance and implement the SEP under Republic Act No. 7611;
WHEREFORE, on motion of Vice Chair Vicente A. Sandoval, duly seconded by Undersecretary Roseller S. De la Pena, the Council RESOLVES, as it is hereby RESOLVED, to create, as it is hereby CREATED , a JOINT PCSD-DENR Coordinating Committee, which shall serve as clearing house where all issues and concerns pertaining to the complementary mandate of the PCSD and DENR will be discussed prior to presentation to the PCSD;
RESOLVED FURTHER, that the Committee shall be composed of three representatives from PCSD and three representatives from DENR and that the Council Secretary be directed, as he is hereby directed, to choose the PCSD representatives who will sit as members of the Committee;
RESOLVED FINALLY, that copies of this resolution be furnished the Secretary of DENR for his consideration.
