PCSD RESOLUTION NO. 94-54

RESOLUTION EXPRESSING SUPPORT TO THE PROPOSED FISHERIES CODE AND REQUESTING THE HONORABLE MEMBERS OF CONGRESS TO ACT EXPEDITIOUSLY AND THE EARLY PASSAGE OF THE SAID CODE.

WHEREAS, R.A. 7611, otherwise known as the Strategic Environmental Plan (SEP) for Palawan, took effect on 19 June 1992 and section 16 of said Act provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for the Sustainable Development (PCSD), under the Office of the President;

WHEREAS, the PCSD, in its 20th Council meeting held on 18 February 1994, adopted the guidelines in implementing the ECAN, prescribing among others, the allowable activities within the identified zones;

WHEREAS, the PCSD, in its 20th Council meeting held on 26 November 1993, adopted the guidelines for the identification and delineation of ancestral domain and land claims;

WHEREAS, R.A 7611 provides that SEP’s General philosophy, the sustainable development of Palawan, aims to foster equity in access to resources and the benefits derived from them;

WHEREAS, it has been observed by the council that in most instance the sale of land and / or lease agreements entered into by ICCs and/or between local landowners and expatriate investor in Palawan have been to the disadvantage of the ICC’s and/or local landowners, consequently depriving the latter of the real and actual value of the land they own or claim;

WHEREAS, the PCSD recognizes the need to protect the interest of the ICC’s and landowners in the Province.

NOW THEREFORE, upon motion by Maj. Gen. Carlos F. Tanega, duly seconded by all the members of the Council present;

RESOLVED, as it hereby resolved, that the Council shall review all transactions pertaining to the sale of land or lease agreements entered into by the ICC’s and/or between local landowners and expatriate investors in Palawan;

RESOLVED FURTHER, that the council direct, as it hereby directs, the PCSD staff in cooperation with the PCSD ‘s Committee on Tribal Affairs and concerned agencies to prepare the guidelines and implement the same to carry out effectively this policy resolution;

RESOLVED FINALLY, that copies of this resolution be sent to the Department of Environment and Natural Resources, Office of Southern Cultural Communities, Registrar of Deeds, Local government units and other concerned agencies for their information, consideration and appropriate action;
