PCSD RESOLUTION NO. 16-541
“AUTHORIZING THE PCSDS EXECUTIVE DIRECTOR NELSON P. DEVANADERA TO SIGN THE DEED OF CONVEYANCE BETWEEN THE MUNICIPAL GOVERNMENT OF QUEZON, PALAWAN AND THE PALAWAN COUNCIL FOR SUSTAINABLE DEVELOPMENT OVER THE 1,000 SQUARE METERS OF LOT PRESENTLY OCCUPIED BY THE DISTRICT MANAGEMENT OFFICE IN BARANGAY POBLACION, QUEZON, PALAWAN AND ALL PERTINENT DOCUMENTS RELATIVETHERETO, SUBJECT TO APPLICABLE LAWS, RULES AND REGULATIONS”
WHEREAS, Republic Act No. 7611, otherwise known as the Strategic Environmental Plan (SEP) for Palawan, took effect on 19 June 1992 section 6 of which provides that the SEP shall serve as the framework to guide the government agencies concerned in the formulation of plans, programs and projects affecting the environment and natural resources of Palawan;
WHEREAS, Section 16 of the same law provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD);
WHEREAS,Section 19 of the same law empowers the Council to perform related functions which shall promote the development, conservation, management and utilization of the natural resources of Palawan;
WHEREAS, to effectively perform all its functions, the PCSD maintains district management offices in thedifferent municipalities in Palawan;
WHEREAS, in 1993, the local government unit of Quezon, Palawan, through Sangguniang Bayan Resolution No. 93-68, conveyed 2,400 square meters portion of its municipal park as site of PCSDS District Management Office in Quezon;
WHEREAS, in 1994, the above-mentioned resolution was amended by virtue of Sanggguniang Bayan Resolution No. 94-11 and Resolution No. 94-12reducing the area to only 1,000 square meters, particularly described as follows:
WHEREAS, the above-described parcel of land is now the site of the present District Management Office in Quezon Palawan;
WHEREAS, in the session of Sangguniang Bayan of Quezon on January 12, 2016 where PCSDS was invited, the conveyance was confirmed for 1,000 square meters or such size that the present fence enclosing the DMO office may contain and provided that the cost of survey delineating the donated lot from the mother title of the Park shall be shouldered by the PCSDS;
WHEREAS,for and in consideration of the continuous services and fulfillment of the duties and functions of PCSD, and as an act of liberality and generosity, the LGU-Quezon desires to voluntarily and fully convey the above-described property and all improvements thereon, if any, to PCSD to be administered and held for unrestricted public purposes;
WHEREAS, the PCSD desires to accept the conveyance of the property subject to the terms and conditions of the Deed and pursuant to applicable laws, rules and regulations:
NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to authorize the PCSDS EXECUTIVE DIRECTOR NELSON P. DEVANADERA to sign the deed of conveyance between the municipal government of Quezon, Palawan and the Palawan Council For Sustainable Development over the 1,000 square meters of lot presently occupied by the District Management Office in Barangay Poblacion, Quezon, Palawan and all pertinent documents relative thereto, subject to applicable laws, rules and regulations;
RESOLVED FINALLY, that copy of this Resolution be furnished the LGU-Quezon and agencies concerned for their information, guidanceand reference.
