PCSD RESOLUTION NO. 99-142
A RESOLUTION FURTHER AMENDING PCSD RESOLUTION NO. 98-118 REITERATING THE REQUIREMENT FROM CARRIERS, TRADERS, AND CATCHERS OF LIVE FISH IN PALAWAN TO OBTAIN ACCREDITATION FROM PCSD
WHEREAS, Section 16 of Republic Act 7611 otherwise known as the Strategic Environmental Plan (SEP) for Palawan Act provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD);
WHEREAS, Section 6 of RA 7611 also provides that the SEP shall serve as the framework to guide the government agencies concerned in the formulation and implementation of plans, programs and projects affecting the environment and natural resources of Palawan;
WHEREAS, Section 19 of RA 7611 vests to the PCSD the power to call on any department, bureau, office, agency or instrumentality of the Government, private entities and organization for cooperation and assistance in the performance of its functions;
WHEREAS, the same section vests to the PCSD the power to perform related functions which shall promote the development, conservation, management, protection and utilization of the natural resources of Palawan;
WHEREAS, the PCSD in the performance of its functions adopted on 27 October 1995 Resolution No. 95-89 urging the Department of Agriculture to formulate and issue the appropriate instrument to ban completely live fish trading in Palawan and Resolution No. 95-90 urging the congressmen of the first and second congressional districts of Palawan to incorporate in the Fisheries Code and/or to initiate legal measures to completely ban live fish trading in Palawan;
WHEREAS, PCSD knows of no Department of Agriculture Administrative Order prohibiting live fish trading in Palawan;
WHEREAS, even Republic Act 8550 otherwise known as the Philippine Fisheries Code of 1998 does not contain a provision prohibiting live fish trading in Palawan and in the entire Philippines;
WHEREAS, realizing that live fish trading in Palawan has not stopped and that there is a need to regulate such activity, the PCSD on January 30, 1998 passed Resolution No. 98-118 requiring all carriers of live fish by land, air and sea in Palawan to obtain permit from the PCSD;
WHEREAS, on October 16, 1998 the PCSD passed Resolution No. 98-124 amending Resolution No. 98-118 to include carriers, catchers, shippers, fishing boat operators and dealers and all others concerned with the business of catching and shipping of live fish from Palawan to obtain permit;
WHEREAS, to enforce said resolution the, PCSD after exhaustive deliberations agreed to adopt a mechanism by which live fish traders, carriers and/or catchers will be required to secure a permit or accreditation and similar instruments from PCSD.
WHEREFORE, upon the motion of Vice Chairman Vicente Sandoval, unanimously seconded by the members present, be it:
RESOLVED, as it is hereby RESOLVED that in order for the PCSD to monitor live fish trading in Palawan and to enforce PCSD Resolution No. 98-118, all carriers, traders, catchers and all others concerned with the business of catching and shipment of live fish in Palawan must secure from PCSD a permit or a letter of accreditation prior to operation.
RESOLVED FURTHER, that a letter of accreditation may be issued by the PCSD only upon submission and evaluation of the required documents as listed in Attachments “A”, “B” and “C”, hereto attached as integral part of this resolution.
RESOLVED FINALLY, that the issuance of the letter of accreditation shall be in accordance with the existing laws, rules and regulations on live fish trading in Palawan.
