PCSD RESOLUTION NO. 99-140
“A RESOLUTION ADOPTING THE EXISTING LAWS, RULES AND REGULATIONS SET FORTH BY THE DEPARTMENT OF AGRICULTURE AND THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES ON FISHERIES AND MINING”
WHEREAS, R.A. 7611, otherwise known as the Strategic Environmental Plan (SEP) for Palawan, took effect on 19 June 1992 and Section 16 of said Act provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council For Sustainable Development (PCSD), under the office of the President;
WHEREAS, Section 6 of R.A. 7611 also provides that the SEP shall serve as the framework to guide the government agencies concerned in the formulation of plans, programs and projects affecting the environment and natural resources of Palawan;
WHEREAS, Section 7 to Section 11 of said Act provides for the establishment of an Environmentally Critical Areas Network (ECAN), the main strategy of SEP which is a graded system of protection and development control over the whole of Palawan;
WHEREAS, the PCSD, in its 23rd Council meeting held on 18 February 1994, adopted the guidelines in implementing the ECAN, prescribing among others, the allowable activities within the identified zones;
WHEREAS, on the basis of R.A. 7611, the PCSD recognized the need to implement regulations pertaining to the exploitation of the natural resources in Palawan, particularly in the Kalayaan Group of Islands where other foreign nationals may exploit its fisheries and mineral resources;
WHEREAS, since the Kalayaan Group of Islands is within Palawan where the PCSD exercises its jurisdiction and PCSD does not have yet its own rules and regulations pertaining to the exploitation of natural resources, specifically on fisheries and mining, there is a need to adopt the existing fisheries and mining laws, rules and regulations as PCSD’s own laws, rules and regulations;
WHEREFORE, on motion of Vice Chairman Vicente Sandoval, unanimously seconded by the members present, be it;
RESOLVED, as it hereby RESOLVED, that the Council adopts, as it is hereby ADOPTED, the existing laws, rules and regulations of the Department of Agriculture and the Department of Environment and Natural Resources on Fisheries and Mining, respectively;
RESOLVED FINALLY, that copies of this Resolution be furnished the Department of Agriculture and the Department of Environment and Natural Resources, the Local Government Units and other concerned entities for their information and guidance.
