PCSD RESOLUTION NO. 99-136
A RESOLUTION REMINDING THE PROVINCIAL MINING REGULATORY BOARD AND THE PROVINCIAL GOVERNOR OF THE ABSENCE IN THE REVISED IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 7942 OF A PROVISION THAT AUTHORIZES THE GRANTING OF TEMPORARY OR SPECIAL PERMITS FOR SAND AND GRAVEL EXTRACTION
WHEREAS, Section 16 of Republic Act 7611 otherwise known as the Strategic Environmental Plan (SEP) for Palawan Act provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD);
WHEREAS, Section 19 of RA 7611 vests to PCSD the power to call on any department, bureau, office, agency or instrumentality of the government and on private entities and organizations for cooperation and assistance in the performance of its functions;
WHEREAS, Republic Act No. 7942 otherwise known as the Philippine Mining Act of 1995 and its Implementing Rules and Regulations provides for the New System of Mineral Resources Exploitation, Development, Utilization and Conservation;
WHEREAS, Republic Act No. 7942 and its Revised Implementing Rules and Regulations do not provide for the granting of special or temporary permits for sand and gravel extraction;
WHEREAS, Mr. Reynaldo A. Juan, OIC Regional Director, Mines and Geo-Sciences Bureau, Regional Office IV through a Memorandum dated 09 October 1997 advised Engr. Miguel Rabang, Chairman of the Provincial Mining Regulatory Board in Palawan of the foregoing limitation and the mandatory requirement of an Environmental Compliance Certificate (ECC) in the issuance of commercial sand and gravel permit;
WHEREAS, despite such advice, temporary permits were still being issued, resulting to destructive sand and gravel extraction and creating conflict not only among barangay residents but also among officials of concerned agencies.
NOW, THEREFORE, on motion of Atty. Grizelda Mayo-Anda, unanimously seconded by the members present, be it:
RESOLVED, as it is hereby RESOLVED, to remind the Provincial Mining Regulatory Board and the Provincial Governor of the absence in the Revised Rules and Regulations Implementing Republic Act No. 7942 of a provision that authorizes the granting of temporary or special permits for the extraction of sand and gravel;
RESOLVED FURTHER, that the Provincial Mining Regulatory Board and the Provincial Governor be reminded to comply with the mandatory requirement of Environmental Compliance Certificate prior to the issuance of Commercial and Industrial Sand and Gravel Permits;
RESOLVED FINALLY, that copies of this resolution be furnished the Provincial Mining Regulatory Board, the Provincial Governor and other concerned agencies for information and guidance.
