PCSD RESOLUTION NO. 98-118

A RESOLUTION REQUIRING ALL THE CARRIERS OF LIVE FISH BY LAND, AIR AND SEA IN PALAWAN TO OBTAIN PERMIT FROM THE PCSD AND AUTHORIZING THE PHILIPPINE NATIONAL POLICE TO IMPLEMENT THE MONITORING ACTIVITIES

WHEREAS, R.A. 7611 otherwise known as the Strategic Environmental Plan for Palawan declares as one of its policies to support and promote the sustainable development goals for the province through proper conservation, utilization and development of natural resources to provide optimum yields on a containing basis;

WHEREAS, Section 4 of the same Act provides that the SEP shall guide local government of Palawan and the government agencies concerned in the formulation and implementation of plans, programs and projects affecting said province;

WHEREAS, Section 16 of the Act provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development, also known as the Council;

WHEREAS, necessary functions and powers have been vested to the Council in order to successfully implement the provisions of this Act found in Section 19, such as: Adopt, amend and rescind such rules and regulations and impose penalties therefor for the effective implementation of the SEP and other provisions of this Act (8); Enforce the provision of this Act and other existing laws, rules and regulations similar to or complementary with this Act (9), and Perform related functions which shall promote the development, conservation, management, protection and utilization of the natural resources of Palawan (10);

WHEREAS, Section 19 (3) of the same Act empowers the Council to call on any department bureau, agency or instrumentality of the government, and on private entities and organizations for cooperation and assistance in the performance of its functions;

WHEREAS, reports from the local fishing communities within the Calamian Group of Islands points to the rampant illegal use of cyanide, toxic substance, in the catching of live fish for the live fish industry most of which are exported to foreign markets such as Hong Kong;

WHEREAS, studies have shown that cyanide kills coral polyp, the animal life that build and give productivity to the coral reef and its associated organisms;

WHEREAS, there is difficulty in monitoring the shipment of live fish specifically from the different ports and airports based in Cuyo, Culion, Coron and Busuanga;

WHEREAS, there is an urgency to monitor and control the use of cyanide which is highly related in the existing live fish trading in the province particularly in the aforementioned island municipalities;

WHEREAS, the present permitting and monitoring procedures need to be improved to cope up with the unsustainable and dynamic nature of live fish industry which calls for the concerted efforts of all sectors in the province of Palawan;

NOW THEREFORE, upon the motion by Cong. Vicente A. Sandoval and Cong. Alfredo E. Abueg, Jr. and duly seconded by Exec. Dir. Arthur R. Ventura, the Council;

RESOLVE as it is HEREBY RESOLVED, that all the carriers of live fish by land, air and sea in Palawan shall be required to obtain permit to transport from the Council through the PCSDS;

RESOLVED FURTHER, that the Philippine National Police be directed to implement the monitoring activities;

RESOLVED FURTHERMORE, that all entities authorized by law to carry out monitoring such as the Department of Agriculture through their Cyanide Detection Test Center shall coordinate with the PNP in the development of an improved and effective monitoring scheme to successfully carry out the objectives of this resolution;

RESOLVED FINALLY, that copies of this resolution be furnished to the Philippine National Police, Department of Agriculture, Bureau of Fisheries and Aquatic Resources, Local government units at the municipal and barangay levels, live fish shippers, companies involved in aircraft charter business and other concerned agencies;

APPROVED AND ADOPTED during the 55th Council meeting held at the House of Representatives, Congressional Hills, Quezon City, last 30th day of January 1998.
