PCSD RESOLUTION NO. 97-114

RESOLUTION ASKING THE TWO CONGRESSMEN OF PALAWAN TO HOLD A CONGRESSIONAL INVESTIGATION AND CALL ON ALL THE GOVERNMENT AGENCIES THAT ARE INVOLVED IN THE ISSUANCE OF LICENSE/PERMITS FOR COMMERCIAL FISHING INCLUDING THE MARINA

WHEREAS, R.A. 7611 otherwise known as the Strategic Plan for Palawan Act has been signed into law June 19, 1992 Sec. 4 of which provides that SEP shall guide the local government of Palawan and the government agencies concernedin the formulation and implement of plans, programs and projects affecting said province;

WHEREAS, Sec, 2 of the same Act stipulates the promotion, encouragement and the involvement of all sectors of society and maximize people participation (including tribal groups in natural resources management, conservation and protection;

WHEREAS, Sec. 12 of R.A. 7611 provides for the management of resources outside of ECAN such as coastal resources, resources of the catchment areas and settlement areas;

WHEREAS, reports reached the Council that rich marine resources of Palawn is presently being threatened by destructive fishing methods such as the use of compressor and illegal fishing by big fishing boats in the municipal waters, including 2 Taiwanese vessels allegedly with licenses issued by MARINA to fish in Palawan waters, specifically in the Sulu area;

WHEREAS, P.D. 776 allows foreign vessels to operate within the country for the purpose of carrying out trade not for fishing operation, thus, the Council should exert its authority to abn big fishing boat operation including foreign vessels that are supposedly allowed to fish in Palawan waters;

WHEREAS, the Council recognizes that its most neglected area of responsiblity is on the Coastal/Marine areas and asked the Department of Agriculture to appraise the Council about the issues and problemsconcerning the Marine and Coastal Environment;

NOW,THEREFORE, upon unanimous decision of the Council;

RESOLVE, as it is hereby RESOLVED that the two representatives of Palawan call on all government agencies including MARINA, and conduct a Congressional investigation regarding the issuance of licenses for commercial fishing;

RESOLVED FURTHER, that the PCSD shall detail two PCSD Staff to assist in the Committee on Coastal/Marine Affairs and allocate P/ 10,000 as initial fund to define the extent of Palawan waters according to R.A. 7611 in order to provide a legal basis in the enforcement of the Council’s authority over Palawan waters;

RESOLVED FURTHER, that the Department of Agriculture submit to the Council a list of licenses issued, and to appraise the Council about their regulatory functions that has to do with the Marine and Coastal Environment, especially those related to Palawan.

RESOLVED FINALLY, that copies of this resolution be distributed to the Department of Agriculture, Bureau of Fisheries and Aquatic Resources, MARINA and other concerned agencies.
