PCSD RESOLUTION NO. 07-341

“A RESOLUTION REQUESTING DENR TO IMPOSE A MORATORIUM ON THE ACCEPTANCE OF NEW (MINING) APPLICATIONS, INCLUDING SMALL SCALE MINING, PENDING THE DECLARATION OF MT. MANTALINGAHAN AS PROTECTED LANDSCAPE”

WHEREAS, R.A. 7611, otherwise known as the Strategic Environmental Plan (SEP) for Palawan, took effect on 19 June 1992, Section 6 of which provides that the SEP shall serve as the framework to guide the government agencies concerned in the formulation of plans, programs and projects affecting the environment and natural resources of Palawan;

WHEREAS, Section 16 of the same law provides that the governance, implementation and policy direction of the SEP shall be exercised by the Palawan Council for Sustainable Development (PCSD), under the Office of the President;

WHEREAS, Sections 7 to 11 of said Act provides for the establishment of an Environmentally Critical Areas Network (ECAN), the main strategy of SEP, which is a graded system of protection and development control over the whole of Palawan, including its tribal lands, forests, mines, agricultural areas, settlement areas, small islands, mangroves, coral reefs, seagrass beds and the surrounding sea;

WHEREAS, the Department of Justice (DOJ) through its Opinion No. 90 issued on 20 June 1994 states that for Palawan it is the Council (PCSD) which shall administer and manage protected areas in accordance with, among others, the applicable provisions of the NIPAS law;

WHEREAS, the Council issued Resolution No. 07-328 dated July 27, 2007 approving the proposal to establish the Mt. Mantalingahan as a Protected Landscape;

WHEREAS, during the Mining Summit on December 6, 2007 held at the Legend Hotel, the DENR initially agreed to the proposal that a moratorium on the acceptance of new MPSA and Exploration applications be implemented pending the Presidential Proclamation of Mt. Mantalingahan as a Protected Landscape;

WHEREFORE, upon motion duly seconded, the Council resolves, as it is hereby resolved, to request the Department of Environment and Natural Resources, as it is hereby requested, to issue a Moratorium on the acceptance of new mining applications within the area covered by Mt. Mantalingahan pending its declaration as a Protected Landscape;

RESOLVED FURTHER, that such moratorium shall include application for small scale mining within the coverage of the proposed protected area;

RESOLVED FINALLY, that copy of this resolution be furnished the Department of Environment and Natural Resources, the Provincial Government and the Municipalities of Bataraza, Brooke’s Point, Quezon, Espanola and Rizal.
