PCSD RESOLUTION NO. 07-337

“A  RESOLUTION APPROVING  APPLICATIONS FOR CHAINSAW REGISTRATION AND PERMITS AS RECOMMENDED BY THE PCSD ADJUDICATION BOARD “

WHEREAS,Section 6 of RA 7611 provides that the Strategic Environmental Plan (SEP) shall serve as the framework to guide the government agencies concerned in the formulation and implementation of plans, programs and projects affecting the environment and natural resources of Palawan;

WHEREAS,Section 19 of Republic Act 7611 empowers the Palawan Council for Sustainable Development, herein referred to as the Council, “to formulate plans and policies as may be necessary to carry out the provisions of the Strategic Environmental Plan (SEP) for Palawan”, as well as “to adopt, amend and rescind such rules and regulations and impose penalties therefore for the effective implementation of the SEP”;

WHEREAS, Republic Act 9175, otherwise known as the Chainsaw Act of 2002, provides that it is the policy of the State to conserve, develop and protect the forest resources under sustainable management and to pursue an aggressive forest protection program geared towards eliminating illegal logging and other forms of forest destruction which are being facilitated with the use of chainsaw;

WHEREAS, by virtue of such policy of the State, it shall therefore regulate the ownership, possession, sale, transfer, importation and/or use of chainsaw to prevent them from being used in illegal logging or unauthorized clearing of forests;

WHEREAS,the Council adopted Administrative Order No. 07, Series of 2003, providing for the implementing rules and regulations of the Chainsaw Act of 2002 in the Province of Palawan, which was subsequently amended by PCSD Resolution No. 06-313 providing, among others, the registration of chainsaw units in Palawan;

WHEREAS, the period of registration that ended on September 2004 was re-opened upon the adoption of Resolution No. 06-313 when it provides that no new registration may be granted to any person, natural or juridical, unless the PCSD authorizes such registration through a resolution;

WHEREAS, the PCSD Staff after evaluation, submitted a list of applications with complete requirements to the PCSD Adjudication Board, together with the recommendation to grant chainsaw permits and/or certificate of registration;

WHEREAS, the PCSD Adjudication Board during its meeting on August 23, 2007 in Coron, Palawan acted on the above-mentioned submission of the Staff and after thorough discussion thereof the following applications were approved:

For issuance of Certificate of Registration:

  1. Aldrin M. Tadeo as Orchard/Fruit Tree Farmer
  2. Freddie Verdad for tree pruning & maintenance of Panitian National High School tree plantation
  3. Nolly T. Constantino as Licensed Wood Processor, and
  4. Rebecca Herrera as Licensed Coco Wood Processor/Orchard & Fruit Tree Farmer.

 

For the issuance of Permit to Purchase/Certificate of Registration:

  1. Palawan State University as holder of Socialized Industrial Forest Management Agreement (SIFMA)
  2. Palawan Palm Oil & Vegetable Mills, Inc. for land clearing for palm oil plantation in approved areas, and
  3. Tita S. Jingo for legal purpose.

 

For issuance of  Permit to Sell:

1. Peter Palo

WHEREAS, the PCSD Adjudication Board in its report to the Council recommended the issuance of certificates of registration and permits to the aforementioned applicants;

WHEREFORE, upon motion duly seconded, the Council resolves, as it is hereby resolved, to approve the aforementioned applications for chainsaw registration and permits as recommended by the PCSD Adjudication Board.

RESOLVED FINALLY, that the corresponding certificates of registration and permits be issued accordingly;

APPROVED AND ADOPTED this 24th day of August 2007 at Coron, Palawan.
