PCSD RESOLUTION NO. 06-315
A RESOLUTION STRONGLY OBJECTING TO THE ACTION TAKEN BY THE NCIP PROVINCIAL OFFICER IN PUBLISHING A NOTICE FOR THE ISSUANCE OF CADT IN CALAUIT IN VIOLATION OF THE AGREED PROTOCOL BETWEEN PCSD AND NCIP”
WHEREAS, it has come to the knowledge of the Council that the NCIP, through its Provincial Officer, Mr. Roldan Parangue, has published in two issues of Palawan Times a notice to the public for the processing of the Certificate of Ancestral Domain Title of the alleged indigenous peoples inside the Calauit Game Preserve and Wildlife Sanctuary;
WHEREAS, such action of the NCIP Provincial Officer violates the agreement entered into by and between the NCIP and PCSD wherein both agencies established a protocol governing the exercise of their respective mandates in the Province of Palawan;
WHEREAS, in the established protocol the processing of CADT could only proceed after the PCSD has declared the subject area as tribal ancestral zone pursuant to Section 12 of RA 7611, which is the Environmentally Critical Area Network (ECAN), the graded system of protection and control over the whole province and serving as the main strategy of the SEP for Palawan.
WHEREAS, to date, the PCSD has not proclaimed any portion of Calauit as tribal ancestral zone in view of the existence of Presidential Proclamation No. 1278, which has withdrawn from sale, alienation and disposition some 33,000 ha of the island and declared it as wildlife sanctuary.
WHEREAS, the action of the NCIP likewise contravene the advice of the Department of Justice for coordination among the agencies in the exercise of their respective mandate in the area.
WHEREAS, such publication has emboldened the Sanctuary’s occupants to continuously intensify activities destructive to the environment of the Sanctuary;
WHEREFORE, upon the unanimous action of the members present, the Council RESOLVES as it is hereby RESOLVED to inform the NCIP, as it is hereby informed, of the Council’s strong objection to the action taken by the NCIP Provincial Officer in publishing a notice for the issuance of CADT in Calauit in violation of the agreed protocol between PCSD and NCIP”.
RESOLVED FURTHER, that the NCIP Central Office be advised, as it is hereby advised to inform the NCIP Provincial Office to hold in abeyance any further activity in the area until a satisfactory solution is reached;
RESOLVED FINALLY, that copies of this resolution be furnished the concerned offices of the NCIP and the chairman of the commission for their information and guidance.
