PCSD RESOLUTION NO. 06-313-A

“A RESOLUTION APPROVING THE GUIDELINES PRESCRIBING THE REQUIREMENTS AND PROCEDURES FOR THE DEPUTATION AND DESIGNATION OF WILDLIFE ENFORCEMENT OFFICERS (WEOs) PURSUANT TO REPUBLIC ACT 9147, OTHERWISE KNOWN AS THE WILDLIFE RESOURCES CONSERVATION AND PROTECTION ACT AND ITS JOINT IMPLEMENTING RULES AND REGULATIONS”

WHEREAS, on July 30, 2001 Republic Act 9147, otherwise known as the “Wildlife Resources Conservation and Protection Act” was approved to carry out the national policy of conserving the country’s wildlife resources and their habitat for sustainability;

WHEREAS, Section 4 thereof provides for the jurisdiction of the Department of Environment and Natural Resources (DENR) and Department of Agriculture (DA) in the nationwide implementation of this Act and in the province of Palawan, the jurisdiction was conferred to the Palawan Council for Sustainable Development (PCSD) pursuant to Republic Act No. 7611;

WHEREAS, Section 30 of the same Act requires the implementing agencies to deputize Wildlife Enforcement Officers (WEOs) that shall have the full authority to seize illegally traded wildlife and to arrest violators of the Act subject to the existing laws, rules and regulations on arrest and detention;

WHEREAS, in relation to the aforementioned Section 30, an implementing rules and regulations was jointly issued by the DENR, DA and PCSD, Rule 30.1 of which provides that the Council or its authorized representative shall deputize Wildlife Enforcement Officers from non-government organizations, citizens groups, community organization and other volunteers who have undergone the necessary training for this purpose;

WHEREAS, the joint implementing rules and regulations further provides under the same Rule 30.1 that the training shall include basic knowledge of wildlife laws, rules and regulations; CITES (Convention on International Trade in Endangered Species of wild flora and fauna) provisions; wildlife identification; basic training in the preparation of reports, affidavits, sworn statement, seizure and turn over receipt, inventory report, filing of complaint in court, inspection procedure/safety, surveillance, smuggling techniques, method of concealment, documentation of frauds and detection of falsified or invald documents; and, prosecution of wildlife cases;

WHEREAS, Rule 30.2 of the said joint implementing rules and regulations stipulates that the Philippine National Police (PNP), Armed Forces of the Philippines (AFP), National Bureau of Investigation (NBI) and other law enforcement agencies shall furnish the PCSD with the list of their employees designated as WEOs;

WHEREAS, Rule 30.3 enumerates the qualifications that WEO must possess such as he/she must be literate, at least 18 years old and not more than 60 years old, physically fit and mentally sound, has a good moral character and willing to perform and undertake the functions and duties of a WEO. These qualifications are integrated in the herein approved guidelines;

WHEREAS, the duties and responsibilities of WEOs are explicitly provided under Rule 30.4 of the joint implementing rules and regulations which are incorporated in the herein approved deputation guidelines;

WHEREAS, Rule 30.5 of the above-mentioned implementing rules and regulations requires the Council to prescribe the requirements and procedures for the deputation of WEOs in the province of Palawan;

WHEREFORE, for and in consideration of the foregoing premises and on motion duly seconded, the Council resolves, as it is hereby RESOLVED that the guidelines “Prescribing the Requirements and Procedures for the Deputation and Designation of Wildlife Enforcement Officers (WEOs) Pursuant to Republic Act 9147, otherwise known as the “Wildlife Resources Conservation and Protection Act” and its Joint Implementing Rules and Regulations” shall be effected and implemented by its staff and shall be the basis for the deputation activities in the province of Palawan;

RESOLVED FINALLY, that copies of this resolution be furnished all the agencies concerned for their information and guidance.
