PCSD RESOLUTION NO. 06-279

“A RESOLUTION APPROVING THE GUIDELINES “ESTABLISHING THE DISPOSITION PROGRAM FOR THE CONFISCATED, DONATED OR TURNED OVER WILDLIFE AND PROVIDING GUIDELINES THEREFOR””

WHEREAS, on July 30, 2001 Republic Act 9147, otherwise known as the “Wildlife Resources Conservation and Protection Act” was approved to carry out the national policy of conserving the country’s wildlife resources and their habitat for sustainability;

WHEREAS, Section 4 thereof provides for the jurisdiction of the Department of Environment and Natural Resources (DENR) and Department of Agriculture (DA) in the nationwide implementation of this Act and in the province of Palawan, the jurisdiction was conferred to the Palawan Council for Sustainable Development (PCSD) pursuant to Republic Act No. 7611;

WHEREAS, Section 32, Rule 32.4 of the Joint Implementing Rules and Regulations of RA 9147 (Joint DENR-DA-PCSD Admin. Order No. 1) stipulates that the Council shall promulgate rules or resolutions establishing protocols for the disposition of stranded, abandoned, injured, wounded, or accidentally caught wildlife maintained in wildlife rescue centers;

WHEREAS, the joint implementing rules and regulations further provides under Rule 4.3 that the Palawan Wildlife Rescue and Conservation Center (PWRCC), the lone rescue center in the province shall continue to be under the jurisdiction of the DENR;

WHEREAS, the different law enforcement agencies/authorities such as, among others, the Philippine National Police (PNP), Criminal Investigation and Detection Group (CIDG), Kilusan Sagip Kalikasan (KSK) of the Provincial Government, Kilos Agad Action Center (KAAC) of the Puerto Princesa City Government and Deputized Wildlife Enforcement Officers (WEOs) of the PCSD turn over to the PCSD Staff their confiscated wildlife fauna that are subjected to illegal trading for care and temporary custody;

WHEREAS, on March 22, 2006, the Environment and Natural Resources Committee of the PCSD in its regular meeting reviewed the above-indicated guidelines and recommended the same to the Council for approval;

WHEREFORE, for and in consideration of the foregoing premises and on motion duly seconded, the Council resolves, as it is hereby RESOLVED to approve the guidelines “Establishing the Disposition Program for the Confiscated, Donated or Turned Over Wildlife and Providing Guidelines Therefor” which shall be effected and implemented by the PCSD staff;

RESOLVED FINALLY, that copies of this resolution be furnished all the agencies concerned for their information and guidance.
