PCSD RESOLUTION NO. 06-273

A RESOLUTION AMENDING PCSD ADMIN ORDER No. 7 AND EXEMPTING GOVERNMENT AGENCIES AND/OR OFFICES INCLUDING GOVERNMENT OWNED AND CONTROLLED CORPORATIONS FROM THE PRESCRIBED PERIOD OF REGISTRATION PROVIDED IN PCSD ADMINISTRATIVE ORDER NO. 07, SERIES OF 2003

WHEREAS, Section 2 of Republic Act 7611, otherwise known as the “Strategic Environmental Plan (SEP) for Palawan Act” declares as the policy of the State, consistent with the Constitution, to protect, develop and conserve its natural resources in order to preserve and enhance the environment and at the same time pursue the socio-economic development goals of the country in general;

WHEREAS, Section 9 of Republic Act 9175 or the “Chainsaw Act of 2002” provides that in the Province of Palawan, the provisions thereof shall be implemented by the Palawan Council for Sustainable Development pursuant to Republic Act 7611;

WHEREAS, Section 19 of Republic Act 7611 empowers the PCSD to enforce provisions of other existing laws, rules and regulations similar to or complementary with the SEP law; Perform functions which shall promote the development, conservation, management, protection and utilization of the natural resources of Palawan; and to adopt, amend and rescind rules and regulations for the effective implementation of the SEP;

WHEREAS, the Chainsaw Act of 2002 recognizes the need of agencies of the government, where, in some aspects of their functions require them to own and possess chainsaw units;

WHEREAS, as provided in PCSD Administrative Order No. 07, Series of 2003 otherwise known as the Implementing Rules and Regulations of the Chainsaw Act for the Province of Palawan, the registration period for chainsaw units in the province has ended during the month of September 2004;

WHEREAS, based on the list of registered chainsaw owners in the records of the PCSDS, only a few government agencies and/or offices including Government Owned and Controlled Corporations (GOCCs), have registered their chainsaw units despite the need to do so;

WHEREAS, the Council considers the urgency and the need for government agencies and/or offices including Government Owned and Controlled Corporations (GOCCs)to have their chainsaw units registered, despite the end of the registration period, in order for them to perform necessary government functions which require the use of chainsaw units;

NOW THEREFORE, upon motion of Vice Governor David Ponce De Leon, duly seconded be it RESOLVED as it is HEREBY RESOLVED to exempt Government Agencies and/or Offices including Government Owned and Controlled Corporations from the prescribed period of registration provided in PCSD Administrative Order No. 07, Series of 2003.

RESOLVED FURTHER, that copies of this Resolution be furnished to the Provincial Government of Palawan, the City Government of Puerto Princesa, Municipal Governments in the Province of Palawan, the Department of Environment and Natural Resources, and other concerned government agencies, instumentalities and GOCC’s in the Province of Palawan.
