PCSD RESOLUTION NO. 09-382

“RESOLUTION DIRECTING THE LOCAL GOVERNMENT OF RIZAL, PALAWAN TO TAKE IMMEDIATE ACTION ON THE REPORTED ILLEGAL DEBARKING ACTIVITIES IN RIZAL, PALAWAN AND TO REPORT SUCH ACTIONS TO THE PCSD

WHEREAS, the issuance of Proclamation No. 2152 on the 29 day of December 1981 declared the entire province of Palawan and certain parcels of the public domain and/or parts of the country as mangrove forest reserves;

WHEREAS, pursuant to Republic Act 7611, otherwise known as the “Strategic Environmental Plan for Palawan,” the PCSD has to ensure the protection and conservation of mangroves and the surrounding seas;

WHEREAS, Section 19 of this Act provides that the PCSD shall “(8) adopt, amend and rescind such rules and regulations and impose penalties for the effective implementation of the SEP law, (9) enforce the provisions of this Act and other existing laws, rules and regulations similar to or complementary with this Act; (10) perform related functions which shall promote the development, conservation, management, protection, and utilization of the natural resources of Palawan; and (11) perform such other powers and functions as may be necessary in carrying out its functions, powers, and the provisions of this Act”;

WHEREAS, it is inherent in the PCSD, as an administrative body, to implement the Strategic Environmental Plan in Palawan and, therefore, take the necessary measures in protecting and conserving mangroves as part of the Coastal/Marine Zone;

WHEREAS, the PCSD, through Resolution No. 98-118-A, adopted Republic Act No. 8550, otherwise known as the “Philippine Fisheries Code of 1998”, which was passed into law on February 25, 1998 to carry out the declared policy of the state of “ensuring the conservation, protection and sustained management of the country’s fishery and aquatic resources”;

WHEREAS, the PCSD, through Resolution No. 00-166, declared the act of mangrove debarking illegal and the mere possession of tanbark as “illegal per se” in the province of Palawan;

WHEREAS, the PCSD, through Resolution No. 05-251, authorized the Executive Director of PCSDS to take immediate action to dismantle/remove any structure which obstructs the natural flow of tide in mangrove forests and to ensure the conservation and protection of mangroves;

WHEREAS, the PCSD, through Resolution No. 06-316, promulgated Administrative Order No. 11, otherwise known as “Rules and Regulations governing the Conservation and Protection of Mangrove Areas” on December 15, 2006, Section 12 of which provides that “pursuant to PCSD Resolution No. 00-166, the act of debarking is hereby declared as illegal and the mere possession of tanbark as illegal per se in the province of Palawan”;

WHEREAS, during the 155th PCSD Meeting, the PCSDS OIC Executive Director reported that the PCSDS has convened the representatives of WESCOM, PNP, Coastguard, PNP Maritime and KSK to strategize and plan an operation including the burning of tan barks;

WHEREAS, on the same meeting, the DENR Representative added that during the last quarter of 2008, the DENR and other agencies/organizations were able to conduct three operations involving three motorized vessels involved in the shipment of tanbark to Malaysia;

WHEREAS, representative from non-government organizations manifested that The alleged illegal debarking activities extends to Bgy. Taburi, Bgy.Latud, Bgy Panalingaan, Bgy. Punta Baja and Bgy. Ransang all in the municipality of Rizal Palawan;

WHEREAS, the Council agreed to direct the Local Government of Rizal to immediately take action against the reported massive debarking activities therein and to submit a report before the PCSD of such action;

WHEREFORE, after a thorough deliberation and upon motion duly seconded, BE IT RESOLVED, as it is hereby resolved, TO DIRECT the Local Government of Rizal, as hereby it is directed, (1) to take immediate action against the massive debarking activities within its territorial jurisdiction, especially in the areas of Taburi, Latud, Panalingaan, Punta Baja and Ransang and (2) to report such action before the PCSD;

RESOLVED FINALLY, that a copy of this resolution be furnished to the Local Government of Rizal, Palawan for appropriate action.
