PCSD RESOLUTION NO. 16-560

 

AMENDING SECTION 11 OF PCSD RESOLUTION NO. 14-508 APPROVING THE REVISED GUIDELINES FOR THE REGULATION AND MONITORING OF THE CATCHING, TRADING, CULTURING, TRANSPORTING AND EXPORTING OF REEF-FISH-FOR-FOOD IN THE PROVINCE OF PALAWAN FURTHER AMENDING PCSD ADMINISTRATIVE ORDER NO. 05, SERIES OF 2014

 

WHEREAS,On October 28, 2014, Resolution No. 14-508 was passed approving the “Approving The Revised Guidelines For The Regulation And Monitoring Of The Catching, Trading, Culturing, Transporting And Exporting Of Reef-Fish-For-Food In The Province Of Palawan Further Amending PCSD Administrative Order No. 05”;

 

WHEREAS, Section 9 of PCSD Resolution No. 14-508 states that “The catching and trade of reef-fish-for-food for trade and domestic consumption shall be subject to the size limits set forth in the Provincial, Municipal and City Ordinance. Provided however, that for purposes of this Order, the size of the covered reef-fish-for-food that may be caught from the wild shall be 32 centimetres or more but in no case shall exceed 47 centimetres”;

 

WHEREAS, Section 11 of PCSD Resolution No. 14-508 states that “In order to ensure the sustainability of reef-fish-for-food industry, the PCSD Staff and its partner agencies/entities shall coordinate with and assist the local government units in establishing 30% of their municipal

 

 

waters as Marine Protected Areas as provided for under the provincial ordinance on reef-fish-for-food. Provided that, spawning aggregation sites shall be prioritized for designation of MPAs. Provided further, that half of the 30% declared MPAs under the preceding section shall be categorized as core zones. For this purpose, the concerned PCSD Staff shall update the ECAN Map and integrate this requirement”;

 

WHEREAS,the PCSD, to be able to provide sound and science- based management policy decisions is maintaining a 27-member multi-disciplinary Scientific Advisory Panel (SAP) composed of well-known country experts and scientists from various disciplines;

 

WHEREAS, during the recently concluded 2nd SAP meeting held at the Citystate Asturias Hotel, Tiniguiban, Puerto Princesa City, Palawan on 16 September 2016, the Reef-Fish-For-Food regulatory measure was discussed;

 

WHEREAS, during the said meeting, the SAP recommends for the amendment of the provisions of Section 11 of PCSD Resolution No. 14-508 citing that NO TAKE ZONES of MPAs should be established to at least 30 percent of the municipal waters;

 

WHEREAS, the SAP further recommends to institute a buffer zone of at least 5 to 10 kilometer radius, considering ocean current patterns, spawning, feeding, sleeping and nursery sites;

 

WHEREAS, the SAP recommends further to increase the minimum size catch limit from 32 cm to 36 cm to ensure that the species of this size has already contributed to optimum production of larvae, considering 36 cm is the species size at peak reproductive capacity;

 

WHEREAS, in today’s meeting the merits of the above recommendations by SAP was exhaustively discussed;

 

WHEREAS, concerned LGUs favor the adoption of the recommendation to declare 30 percent of the municipal waters as NO TAKE ZONE;

 

WHEREAS, amending the size limits requires consultation with the affected fisher folks prior to the adoption of the said recommendation;

 

WHEREFORE, above premises considered, Section 11 of Admin Order No. 05, series of 2014 is hereby amended to read as follows:

 

Section 11. Additional MPAs (Core Zones) and Zones for Hatcheries. In order to further ensure the sustainability of reef-fish-for-food industry, the PCSD Staff and its partner agencies/entities shall coordinate with and assist the local government units in establishing 30% of their municipal waters as Marine Protected Areas as provided for under the provincial ordinance on reef-fish-for-food. Provided that, spawning aggregation sites shall be prioritized for designation of MPAs.

 

Provided further, that the entire 30% declared as MPAs under the preceding section shall be categorized as core zones. For this purpose, the concerned PCSD Staff shall update the ECAN Map and integrate this requirement.

                    

RESOLVED FURTHER, that copies of this resolution be sent to all Local Government Units and other concerned agencies and parties for information and guidance;

 

RESOLVED FINALLY, that copy of this resolution be published in newspaper of general circulation in the Province of Palawan and deposited at the Office of the National Administrative Register of the UP Law Center, Diliman, Quezon City;
