PCSD RESOLUTION NO. 16-557

DONATING ONE (1) UNIT OF FORFEITED CHAINSAWWITH SERIAL NUMBER 120808067IN FAVOR OF THE 12TH MARINE BATTALION IN NAGOYA BARRACKS,  BATARAZA, PALAWAN ACCORDANCE WITH PCDS ADMINISTRATIVE ORDER NO. 7 OR THE REVISED IMPLEMENTING RULES AND REGULATIONS OF THE CHAINSAW ACT OF 2002”

 

WHEREAS, pursuant to Republic Act 7611, otherwise known as the “Strategic Environmental Plan (SEP) for Palawan Act,” the Palawan Council for Sustainable Development is endowed the duty to promote the development, conservation, management, protection, and utilization of the natural resources of Palawan;

 

WHEREAS,it is the declared policy of the SEP Law to support and promote the sustainable development goals for the provinces through proper conversation, utilization and development of natural resources to provide optimum yields on a continuing basis. With reference to forest resources, the State shall pursue and implement forest conservation and protection through the imposition of a total commercial logging ban;

 

WHEREAS,in the Province of Palawan, the power to effectively implement the provisions of Republic Act 9175 of the “Chainsaw Act of 2002” is vested with the Palawan Council for Sustainable Development which duty includes the obligation to coordinate with the local

 

governments and other concerned agencies to ensure that the latter’s plan, programs and projects are aligned with the plans, programs and policies of the SEP for Palawan Act;

 

WHEREAS, Section 24 of PCSD Revised Administrative Order No. 07, (AO 07) Series of 2012 or the Revised Implementing Rules and Regulations of the Chainsaw Act of 2002 provides for the Disposition of Forfeited Chainsaw Units which states that chainsaw units which are forfeited under AO 07 in favor of the government may be disposed of through sale and donation in favor of National Government Agencies, Local Government Units and Government Owned and Controlled Corporations;

 

WHEREAS, the 12th Marine Battalion in Bagoya Barracks, Brgy. Rio Tuba, Bataraza, Palawan charged to perform duties and responsibilities to protect the community of any intrusion form lawless elements, uphold peace and order is also tasked to perform Disaster Risk Reduction during calamities and accidents to prevent further damage to property and loss of life in their area of operations;

WHEREAS, on August 31, 2016, in a letter-request, the 12th Marine Battalion through 1LT Robinson A RetorianoJr PN(M)  requested that a chainsaw unit be awarded to the 12th Marine Battalion in Bataraza, Palawan to be utilized during operations on Disaster Risk Reduction;

WHEREAS, in today’s meeting, as a favourable response on the said request,one unit of forfeited chainsaw in the custody of the PCSDS with serial number 120808067 shall be donated in favor of the 12th Marine Battalion on the condition that the use of the donated chainsaw shall be for Disaster Risk Reduction purposes only;

 

WHEREFORE, in consideration of the foregoing premises and on motion duly seconded, the Council resolves to authorize PCSD Executive Director Nelson P. Devanadera, as it he is hereby AUTHORIZED to execute the corresponding Deed of Donation in favor of the12th Marine Battalion in Bagoya Barracks, Brgy. Rio Tuba, Bataraza, Palawancovering one (1) unit of forfeitedchainsaw with serial number 120808067;

 

RESOLVED FINALLY, thatcopies of this resolution be furnished the 12th Marine Battalion and other concerned agenciesfor their information and guidance;

 

ADOPTED AND APPROVED this 16th day of September 2016 at DA Conference Room, Elliptical Road, Diliman, Quezon City.
