PCSD RESOLUTION NO. 16-555

“AMENDING THE ECAN MAP OF SITES A, B, C AND D LOCATED IN THE MUNICIPALITY OF ABORLAN, PALAWAN FROM CONTROLLED USE ZONE TO CORE ZONE, CONTROLLED USE ZONE TO RESTRICTED USE ZONE, CONTROLLED USE ZONE TO RESTRICTED USE ZONE AND CONTROLLED USE ZONE TO RESTRICTED USE ZONE RESPECTIVELY”

 

WHEREAS, Section 20 of Republic Act No. 7611 or the SEP for Palawan Act provides that the Palawan Council for Sustainable Development Staff(PCSDS) shall serve as the regular professional support staff of the Council and shall provide the machinery to coordinate the policy and functions, implement programs, and organize such services as may be required by the Council;

 

WHEREAS,Section 7 to 11 of the same law provides for the establishment of an Environmentally critical Areas Network (ECAN), the main strategy of the SEP Law, which is a graded system of protection and development control over the whole of Palawan, including itstribal lands, forests, mines, agricultural areas, settlement areas, small islands, mangroves, coral reefs, seagrass beds and the surrounding sea;

 

WHEREAS, the areas covered by the ECAN shall be classified into three (3) main components namely: (1) Terrestrial: which consists of the mountainous as well as ecologically low hills and lowlands areas of the whole province. It may by further subdivided into smaller

 

management components; (2) Coastal/marine area: this area includes the whole coastline up to the sea. This is characterized by active fisheries and tourism activities; (3) Tribal Ancestral lands: these lands are the areas traditionally occupied by the cultural communities.

 

WHEREAS, Section 9 of the same law provides for the Terrestrial Component: Management Scheme and Zonation. – the terrestrial components may be further subdivided into smaller management components for a more efficient supervision, to wit:

 

 (1)  Area of maximum protection or core zone – This zone shall be fully and strictly protected and maintained free of human disruption. xxx

 

(2) Buffer zone – This area permits regulated use and may be further subdivided into three (3) sub-zones;

 

  • Restricted use area. Generally surrounds the core zone and provides a protective barrier. Limited and nonconsumptive activities may be allowed in this area.
  • Controlled use area. Encircles and provides the outer barrier to the core and restricted use area. Controlled forest extraction, like the collecting of minor forest products, and strictly controlled logging and mining may be allowed.
  • Traditional use area. Edges of intact forests where traditional land use is already stabilized is being stabilized. Management and control shall be carried out with the other supporting programs of the SEP.

 

(3) Multiple/manipulative use area – This is the area where the landscape has been modified for different forms of land use such as intensive timber extraction, grazing and pastures, agriculture and infrastructures and development. Control and management shall be strictly integrated with the other supporting programs of the SEP and other similar programs of the Government. xxx

 

WHEREAS,Section 22 of PCSD Resolution No. 05-250 or the “Resolution Adopting the Revised Guidelines in Implementing the Environmentally Critical Areas Network, the Main Strategy of the Strategic Environmental Plan (SEP) for Palawan, amending PCSD Resolution Nos. 94-44 & 99-144” which provides for the Map Revision/Modification provides that subsequent revisions and updating of the ECAN Zoning Map may be undertaken by the Council staff upon acquisition of new and relevant information, in consultation with the local government units and concerned sectors in the province;

 

WHEREAS, Section 23 of the same law provides for the Declaration of the ECAN Zones Map which states:

 

Upon recommendation by the PCSD Staff, the LGU through its Sangguniang Bayan shall submit to the PCSD its ECAN Zones Map (with the technical descriptions and the allowable activities for each zone) for approval. Such map shall be guided by the provisions of these guidelines. The same map shall be subject to progressive review and update by the PCSD Staff and the LGU through its ECAN Board upon acquisition of more information on the environment condition of the terrestrial and coastal/marine areas for review and final approval of PCSD. After PCSD approval of the ECAN Zones Map, the LGU shall support the PCSD action through adoption of the ECAN Zones Map by local resolutions and ordinances.”

 

WHEREAS, the Sangguniang Bayan of Aborlan submitted a proposal for an amendment in the ECAN Map of the Municipality of Aborlan, Palawan based on the ECAN Zones Validation Report by the Palawan Council for Sustainable development Staff (PCSDS); to wit:

The area was previously zoned as Controlled Use Zone because its elevation is below 500 meters above sea level and the dominant slope range is 19%-35%. The land cover based on 1998 LandSat TM image is classified as residual/secondary forest; however, upon field validation, it was found out to be an old-growth forest. Thus, recommended to be Core Zone

 

B Talakaigan, Barangay Cabigaan 1,782 Controlled Use Zone Restricted Use Zone The area was previously zoned as Controlled use Zone because its elevation is below 500 meters above sea level and the dominant slope range is 19%-35%. Its cover is residual forest based on 1998 LandSat TM image. The area is recommended to be re-zoned to Restricted Use Zone because it’s a critical watershed used for irrigation and other domestic purposes.
C Barangay Baraki

 

837 Controlled Use Zone Restricted Use Zone The area was previously zoned as Controlled Use Zone because the dominant slope ranges from 19%-35% and the land cover is residual forest. However, upon field validation and GIS analyses, the elevation of the area is between 500-700 meters above sea level. Thus, recommended to be re-zoned to Restricted Use Zone.
D Barangay Sagpangan

 

655 Controlled Use Zone Restricted UseZone The area was previously zoned as Controlled Use Zone because the dominant slope ranges from 19%-35% and the land cover is residual forest. However, upon field validation and GIS analyses, the elevation of the area is between 500-700 meters above sea level. Thus, recommended to be re-zoned to Restricted Use Zone.

 

WHEREAS, upon review and deliberation of the information on the environmental conditions of the proposed amendments of the ECAN Map of the subject terrestrial submitted by the Sangguninag Bayanof Aborlan, Palawan, this Council finds it necessary that the ECAN Zone of Sites A, B, C and D located at Talakaigan, Barangay Cabigaan, Talakaigan, Barangay Cabigaan, Barangay Baraki and Barangay Sagpangan, respectively be changed from Controlled Use Zone to Core Zone, Controlled Use Zone to Restricted Use Zone, Controlled Use Zone to Restricted Use Zone and Controlled Use Zone to Restricted Use Zone, respectively for the above-mentioned reason/justification;

 

WHEREFORE, in consideration of the foregoing premises and on motion duly seconded, the Council resolves as it is hereby resolved AMENDING, the ECAN Mapof Sites A at Talakaigan, Barangay Cabigaan(from Controlled Use Zone to Core Zone),B at Talakaigan, Barangay Cabigaan (Controlled Use Zone to Restricted Use Zone), Cat Barangay Baraki(from Controlled Use Zone to Restricted Use Zone) and D at Barangay Sagpangan  (Controlled Use Zone to Restricted Use Zone), in the Municipality of Aborlan, Palawan;

 

RESOLVED FURTHER, the Local Government of Aborlan, Palawan, is hereby directed in coordination with its ECAN Board, the PCSD Staff, and other concerned agencies and members of the community to undertake afield delineation and the Preparation of the ECAN Zoning Plan;

 

RESOLVED FINALLY, that copies of this resolution be furnished to the Municipal Government of Aborlan, Palawan,other concerned agencies and LGU’s for their information and guidance;
